I;m not a lawyer but I would say that if you want you can avoid
libpcap at all and go down to PF_RING. This is faster than passing
though pcap and it gives you access to facilities (see for instance http://luca.ntop.org/IM2009_Tutorial.pdf)
that are not allowed from pcap.
