SCO will lose the trademark if they don't use it for a certain amount of time.

I already mentioned the fact that the OpenGroup owns the UNIX trademark.

OpenUNIX is a derived Trademark and you would need an approval from the 
OpenGroup for it. I would asume we can only use it after SCO lost it and in 
case that the OpenGroup gives the approval that is most likely coupled to
a POSIX certification. Something that is hard to impossible to achive for
several independent distros.
