I think that's part of the dispute here. The "OpenSolaris" trademark, the opensolaris.org domain, and the infrastructure running the web site and related systems are all Sun assets. That part is true. However, does that make the contents of "index.html" also a "Sun asset" and something that only Sun can determine? I don't believe that it does. I don't think either is being done here. Instead, we have a charter and a constitution that set up an "OpenSolaris community." To the extent that the OGB itself is not Sun, we need to figure out how to manage the identity of the community itself.
