I think this is incorrect. Previously there was Open content and Closed
content. PI was added so that you couldn't accidently open something you
wanted kept closed. You can still have content that is neither Open nor PI;
simply don't indicate that content as being Open (and don't let it be a
derivative of Open content). Remember, Open content is only that you
clearly indicate as being so.
Example:
"All text in this document is Open except the following paragraph. All
portions of this text not indicated as being Open are copyright 2000 by
Walter Christensen."
"Neener, neener, neener. You can't use this paragraph without my
permission. =P"
This way publishers could feel more at ease using their trademarks or
intellectual property without fear of accidentally Opening them by
mistakenly putting them in text marked Open.
