I was suggesting that if the open gaming foundation wants to
be viewed as fair and impartial they shouldn't be directly
involved in this activity.  Will independents and WotC competitors
be allowed to contribute material under OGL and then have the
foundation's website describe their trademark whose usage
terms serve mainly to promote sales of their products?

Apache is a well known "brand" and is promoted by the Apache
Foundation.  But no one is directed to buy services from Collab.net
(Brian Behlendorf) to use the logo.

You're probably right and a clearer distinction on the website is
sufficient at this time.
