> Faustus von Goethe > > In reality, saying "compatible with" is nothing more than an objective > comparison. It doen't dilute or infringe. First of all, "compatible with" is often a SUBJECTIVE comparison, not an objective one (especially in this context), and it is possible to dilute or infringe on a mark through comparison. It is also possible to do it without infringement, but it is the owner of the mark who makes the call as to whether or not they feel infringed upon. They ALWAYS have a shot at winning in court, even if the chances are slim. > IE: I can say my software is > compatible with Microsoft Windows until the sun falls down - > nobody can sue > me unless it is obvious I am lying. Boy, I'd hate to be you if you tried. Microsoft doesn't play by those sorts of rules. I never volunteer for that kind of pain. -Brad ------------- For more information, please link to www.opengamingfoundation.org
