I do not believe this is a secret agenda of WotC.  If this
issue really is a concern, then I suggest the following 
alternative clause for the OGL (adapted from WotC website 
legalese):

"You agree that your use of this License is at your sole risk. 
Wizards and its affiliates, agents, and licensors cannot and 
do not warrant the accuracy, completeness, currentness, 
noninfringement, merchantability, or fitness for a particular 
purpose of the information available through this License.

Neither wizards nor its affiliates, agents, and licensors shall 
be liable to you or anyone else for any claim, loss, or injury, 
other than death or personal injury, arising out of the use of 
this License, caused in whole or in part by their negligence or 
by matters beyond their control."
