chime in.

Okay Kal I understand where you are coming from.


Here's my example:

Product A includes the god Apollo.  The name Apollo is PI, the stats are
OGC.

If you create a product that uses the stats for Apollo And the name, you are
going to have a hard time in court proving that the name wasn't "derived"
from the PI. (IANAL, but I think that derived means "where I got the idea").

However,

Product A includes the god Apollo.  The name Apollo is PI, the stats are
OGC.
Product B uses the OGC Stats and calls the god Ra.

The producers of Product C have never seen product A.  They look at Product
B and say "These abilities don't fit with Ra... let's use them for Apollo."
So, Product C has the stats originally from product A, and a non-derived
name of Apollo.

I could see that standing a chance in court (no prior knowledge of the PI).

Personally, I think this is the reason we need a DB of OGC.
If I use some OGC 3rd hand (I got it from a product who got it somewhere
else), I should be able to see the history of usage without buying the
products (If I can find the products... in the copyright notice it never
says Which book you got it from).
