not true.  you can make a complete, working D20-based system, you can 
publish it for profit, you can do whatever you like with it.

except tell anybody that it's a D20-compatible/-based system.  which 
is great help if what you wanted was a short-cut to a useable RPG 
system for a setting you have in mind, but not so much help if what 
you wanted was same marketing muscle.
