Er, all you need to do is indicated that where content in the main work is
identical to the content in the appendix, it's of course Open Gaming.
So when you see a monster stat block in encoutner 1A, and that same stat
block is listed in the appendix, you know that it's OGC (not that it bloody
well matters, mind you--it's well within the spirit of the OGL for just
about anything to work, as long as gamer X can pick up the work and know
what he can use in his derivitive work.)

Reasonable person Adam picks up "the stars of wellsville", a silly d20 game.
Adam decides he wants to write his own silly game, "Adam's Apples." As long
as he can figure out what parts are open and what parts aren't without
asking, it's all good. It doesn't matter if the OGC is in italics, in an
appendix in the back, or is "everything except for page 9's sidebar."
The only time someone would question how well "the Stars of Wellsville" was
put together is Adam, if the authors of Stars of Wellsville sue him for
breach of the OGL.
