easy: it's perfectly legal. notice how the generic drugs in the
drugstore say something to the effect of "compare to Advil(TM)". If
the deep pockets of the major drug companies can't persuade a judge
that such comparisons are a violation of trademark, i think it's
pretty safe to say they aren't.

in fact, it went to court (though i believe it was settled, rather
than decided by the judge), and Mayfair got away with it. this
either means that it is an appropriate use of another's trademark (if
a judge decided it) or that the trademark owner (TSR) believed that
they would not win the case (which is a strong indication of the
likely legality).

speaking of which: anybody know if there is any place for a lay
person to look up legal history? i know about the Lexus (name?)
database, but that's only available with a hefty subscription fee,
and i don't know of any place around here that gives the general
public access to that. the above is only one of many cases that i've
been meaning to read for meyself, rather than continuing to rely on
others' information.
