I mean 'use' as defined in the OGL. The "gentleman's agreement" proposed by
Ryan Dancey while he was a VP for Wizards of the Coast (pre-Hasbro) has been
referred to as "potentially binding" by some of the more legal-savvy members
of this list. Since that and a really hot cup of coffee will get you sued
anyway, I suggest you consider it from a different angle.

Nearly every d20 work you see these days is derivative of at least one of
those unreleased files, and so for WotC to back out on it now would cause an
outrage in the industry that would make the TSR online-policy flap of the
1980's look like a picnic. Can you say "Public Relations Nightmare?"

Time is the reason it has not been released, and they definitely plan to
release it. WotC has faced at least two staffing reductions since the OGL
was first proposed (just prior to the release of 3e), and Anthony Valtera
(the current primary WotC contact for WotC-owned OGC) is up to his eyeballs
right now. Each of those documents needs to be combed by the R&D staff and
be blessed by legal to ensure that none of the brand-related, character
creation, or experience IP gets released.
