Its really a question of generations and inheritance:

 

Step1: Wizards releases SRD, puts Spell Template into OGC

Step2: Designer X Creates Bob's Bouncing Bullet spell CONCEPT

Step3: Designer X creates a Version of Bobs Bouncing Bullet and releases it as OGC

Concurrent Step 3: Designer X creates a version of Bobs Bouncing Bullet for Palladium who pays a small fee and puts it in their next book.

 

There are now 2 versions of Bob's bouncing Bullet. One is OGC and will continue to be for people who want to put it into their own games, give it to NPCs etc.

 

The Palladium version however is Copyright, will always be copyright and can never be replicated on threat of lawsuit.

Could someone who releases say a spell name, class name, etc as OGC.
Then turn around and give someone else permission to use those in a
non d20 and non OGL product (say a different game system)?

You are going to say yes, that is legal.  But if it is legal, how does
it reconcile with section 3 of the OGL which says that if you use OGC
than you have agreed to abide by the OGL license?
