I would agree with this except they are using the OGL'd material as well
without using the OGL.
    

And they don't have to use the OGL, unless they use something 
that is derived from it. As the owner of the IP,  WOTC has granted 
a special license (the OGL) for anybody to use that material.  They 
are also able to grant other licenses that allows the use of that 
same material (from the actual source, not from the OGL versions) 
along with any other material covered by the license.

Remember, the SDR is just a subset of the PHB, DMG, MM, 
PsiHB, and other products. Those with special licenses are are 
getting special priveledges, yes, but you are also forgetting that 
they are also paying for those priviledges as well, through royalties 
that the folks who use the SRD do NOT have to pay.
  
Which is the point. Why is wizards alowed to treat there copyrighted material that way, but other people are not allowed to treat their own copyrighted material in the same way?
