I do not believe that that is correct; while the are binary and the source is not available, the binary files can be distributed. Note that there are also binary blobs in other drivers (e.g, intel-ucode.txt in the same directory as amd-ocode.bin). The closed tree contains source code which we cannot make available; a tree we cannot distribute. But what we can distribute, even when it contains firmware blobs, is all in the open source tree.
