I wouldn't know of any patent standing in the way of a free digital notary (q.e.d. by gnotary). As far as surety goes, I wouldn't trust them further as I can throw them; their future is uncertain and there is no guarantee that they and their services will still be around in 20-30 years when I might need them. With the peer service, there is admittedly no guarantee either - however, the whole system simply makes it extremely LIKELY that it will be continued as I myself (and any other user of it) will have an influence on this.
