Cool it with the insults, ok Nothing in the MS agreement gives anyone the right to use any patented code, so not only would it be against the GPL, it would be against the law, and set Novell (not anyone else) up for a law suit Plain enough? The only one that would have to pay for putting patented code into the distribution is Novell.
