Justice Department officials have isolated Shaaban Hafiz Ahmad Ali Shaaban, 54, of Greenfield, under a policy that permits the FBI to eavesdrop on his conversations, restrict his access to news reports and prohibit anyone other than attorneys and family members from talking to him, The Indianapolis Star reported. Shaaban is being held under an order known as a special administrative measure, which is meant to keep federal inmates from inciting violent attacks from prison or disclosing classified information that could harm national security. William Dazey Jr., a public defender who assisted Shaaban at his trial in U.S. District Court in Indianapolis earlier trial this year, said the order was unusual. "I have not seen evidence that would support the notion (Shaaban) is a threat to the United States," Dazey said. Among the other convicts held under similar conditions at the Florence Federal Correctional Complex about 90 miles south of Denver are Zacarias Moussaoui, the alleged "20th hijacker" in the Sept. 11, 2001, terrorist attacks, and Richard Reid, who tried in December 2001 to detonate plastic explosives in his shoe on a Paris-to-Miami flight. At Shaaban's sentencing, Judge John Tinder recommended placing Shaaban in a federal prison at Terre Haute, closer to his wife and young son, who remain in Greenfield. However, Assistant U.S. Attorney Sharon Jackson requested the restrictions, and Attorney General Alberto Gonzales initialed the order. Jackson is on special assignment with the Justice Department and was not available for comment Monday, said Mary Bippus, a spokeswoman for the agency in Indianapolis. Shaaban was stripped of his U.S. citizenship after being found guilty in January of six federal charges, including illegally acting as an agent of the Iraqi government. He was sentenced to 13 years, four months in prison after a trial in which prosecutors portrayed him as a clever spy who had offered to sell the names of more than 60 clandestine CIA operatives to Iraqi intelligence officials for millions. Under special administrative measures, the Justice Department must certify a substantial risk exists that an inmate's communications could result in death or serious bodily injury to others. The regulation states the inmate must be notified of the restrictions and the justification. However, Shaaban received an order that redacted the justification. Critics question the necessity and the psychological effects of limiting virtually all contact with the outside world for years at a time. "A lot of this is show. It's playing to people's fears about terrorism," said Khurrum Wahid, an attorney with offices in New York and Miami who defends terror suspects.
