Well... I take the view that if a person forbids text extraction,
then they are implicitly forbidding indexing. Not everyone may
agree.

It is a hard position to agree with - it is hard to imagine the creator would not want his document to be found (and read). I'm not speaking legaleese (adobe's definition of text extraction should be relevant here, and I haven't seen any specific statement on indexing. Does Acrobat index files with text extraction protection?). If the two concepts are associated, it is probably an accident of the technical fact that if you indexed the file you did extract the text, which opens way to potential abuse.
In any case, I am not sure all DRM content is text-extraction protected (but you are probably correct that most of it is).
