They might, and that's why they can apply such restrictions as preventing text extraction and even forbidding screen readers from getting the information.

If you don't have the rights - you don't have the rights...BUT what about if I DO have the rights. I am the author of the document and have the requisite password. I have paid for fair use of the document. (etc.). THEN I should be able to index the document...
But, as Maxim points out - that's not currently possible if the author used a non-Adobe-Standard DRM and/or is using a 3rd party tool that doesn't support proper security models.
Does Acrobat index files with text extraction protection?).
Not that I am aware of, no.
