Yes, and intents can change.
For instance if one hires a model for a photoshoot, the intent (possibly)
is to produce images that will generate income or at least be used to
promote oneself. The need for a release is pretty clear cut.
OTOH, simply taking photographs on the street or at a public event, one
may not know in advance that a photograph will be used in way that may
generate income.
True enough, but if you don't get recognizable people to sign a release on
the spot, you have lost your legal right to use the picture for commercial
gain.
This is not to imply that you can't still do it if your moral code allows
for such things. If the subject of the picture never finds out about it, or
doesn't care to exercise his or her rights, then you won't have a legal
issue to contend with, and you have already proven yourself to be somewhat
morally bereft
Don't people have the responsibility to stay out of the way our lenses?
