You might be interested in how the CTO of Just Sports USA responded to SCOs 
threatening letter to his company.  Just like you, he is eyeing for a BSD solution to 
escape SCO's attacks.  But after getting feedback from the OSS community he decided to

Also, you might want to read http://www.groklaw.net.  You will find a lot of 
information regarding the SCO case.  It details why SCO's case is on very weak grounds.

BTW, if it so happens that SCO will win in their case, I think BSD will not be a safe 
haven as BSD can be SCO's next target.
