CAMDEN — A U.S. District Court judge will decide next week whether four
videos, which show the beheading of at least five members of the United
States military, will be included as evidence in the Fort Dix terrorism plot

Government officials seized the videos from defendant Mohamad Shnewer's
computer, following a series of raids in May 2007.

Shnewer, Serdar Tatar and Dritan Duka, along with his brothers, Eljvir and
Shain, are charged with attempted murder and conspiracy to murder military
personnel. Federal prosecutors allege the men planned to kill soldiers at
Fort Dix and discussed the possibility of carrying out similar attacks at
other venues.

On Monday, Rocco Cipparone, Shnewer's attorney, filed a motion on behalf of
all the defendants, seeking the videos be excluded from the government's
evidence.

The videos, he argued, offer little value to the government's case and would
"unduly prejudice" the jury.

"They are bloody, gory and literally stomach turning," Cipparone wrote of
the videos. "All defense counsel have expressed that these video images and
sounds are some of the most horrific images they ever have seen. Jurors,
even less desensitized than counsel and the court unfortunately will be
based on past experiences - will have an even greater visceral gut-wrenching
reaction that will be impossible to compartmentalize or to shake."

Federal prosecutors have suggested they may only play the videos to just
before the actual beheading and Cipparone wrote that he anticipates federal
prosecutors "will argue that defendant's possession, viewership, and
reaction to these videos demonstrate anti-American sentiments and a
propensity toward violent acts against American persons."

But, Cipparone continued, the government has the ability to make the same
arguments using recorded conversations between defendants and the
government's informant and other, less violent videos seized from the
defendants.

Before the process of jury selection began again on Thursday, U.S. District
Judge Robert Kugler brought up the issue of the videos.

Assistant U.S. Attorney Michael Hammer said the government will file a
response to Cipparone's motion by Tuesday. Kugler scheduled arguments
regarding the videos for Thursday..

By that point, Kugler said, a jury for the case should be seated.

So far, 56 people have been deemed "qualified" to serve as jurors.

The process of seating a jury began last week when 617 people arrived at the
courthouse to fill out questionnaires on their knowledge of the case, biases
and any potential hardships. By Monday, the list was trimmed to about 300
people. The potential jurors are now being brought into the courtroom one by
one to face more in-depth questioning. That process will continue into next
week. Kugler has said he would like a pool of 80-100 qualified jurors from
which the final 12 jurors and six alternates would be selected.
