Ohio mark, you and many others continue to separate "Militia" and "people". The Militia in its definition of the day was a section of the populace (not ALL) that were armed and always loaded in order to defend the population as a whole from any "common enemy".
These were "civilian soldiers" (a term presently being used to describe "national guard" units inaccurately) charged with coming forth on a moments notice. (thus "Minutemen) These units were under absolute LOCAL control and each unit had to vote on a question of joining together with those units from other communities. They could go home when THEY thought it was prudent. "People" were never in possession of the various rights under the second amendment. The Militia was formed of all people that volunteered to be a part of it, they "listed" their arms and persons with the "Militia" (they were NOT limited as to what arms they could possess, but they and their weapons were carried on rolls so the "commander" (normally voted into his role) knew how to best deploy his men in a given situation. None of the cases that have been brought before the USSC have even addressed the issue of the "community based and regulated soldier" or "Militia". Why ?? Even the Court rather handily leaves the "Militia" out of any rulings. There are no laws that I can find that limit any past or present "Militia" on the amount or types of weapons that Militia Members can own. They all address the individual. The individual in my mind was NEVER given the right to bear arms... however individuals with a well regulated "civilian" "voluntary" Militia were. These individuals could opt in and out of the Militia at any time they chose to do so. They gathered and drilled on a regular schedule and bringing in the crop or clearing a field of stumps was considered good reason not to show. Please show me ANYTHING that even approaches the Militia as mentioned in the constitution that exists today. The government is using and trying to slowly adopt the "National Guard" as the modern "Militia" through the use of common terminology that was once reserved to describe the Militia. Some day soon the "Militia" as intended by the language in the constitution will be found to no longer exist and that amendment will be legally struck and or ignored... Want to save your rights ?? form a truly Civilian Militia made up of "men of good and moral character" maintain a roll and a list of arms (all of them) to serve the "common good". The government will claim that the role of the "militia" has been taken over by local and state police and that the duties to "come to the aid of your countrymen" has been relegated to the "civilian" "National Guard" units which are under Federal control and at their beck and call. The days are numbered.
