Prosecution witnesses claim the defendant called the victim a "faggot" but they can't testify that they saw him fire the shot. More witnesses recanted that they saw the shot. The only one so far who claims he was the gunman is the brother of the victim. I don't see that they can claim this as a hate crime under the circumstances.
