Dear Readers: On ‘Face the Nation’, today, Bob Schieffer had Colin
Powell as his guest. Such a show and such guests can’t be allowed in
a viable democracy. That most necessary prohibition isn’t about
ideology, nor skin color, but about avoiding creating the notion in
the minds of viewers that the opinions of any celebrity—or past or
present public figure—are more important than those of the man-on-the-
street.

Schieffer asked Powell how he rated Obama as President, thus far.
You’ll recall that late in the 2008 campaign, Powell endorsed Obama
amid much fanfare. Powell’s reasoning, then, was obviously flawed,
since Obama had no executive experience nor a worthy character.
Hearing Powell repeat essentially the same lies about Obama’s non-
existent attributes, was like having inadvertently feasted on poison.
Where is the Oil of Ipecac when I need it?

Lest any of you suppose, wrongly, that I am opposed to Blacks, for the
past two weeks, I have enjoyed watching the TV show of Professor Henry
Lewis Gates, Jr. who is investigating the genealogy of a diversity of
Americans. Gates has such dignity and aplomb! I was wholly
supportive of Gates when that never-should-have-become-one policeman
arrested Gates on his own property for being rightfully incensed
because of being asked to show I. D. My New Constitution contains the
following:

“… Law enforcement and the courts shall be responsive rather than
proactive, protective without being subjugative, and shall enforce the
New Constitution ahead of any other laws or employment hierarchies.
Racial or other statistical profiling, preemptive arrests, detention
or sentencing are illegal if a person’s constitutional rights are
violated.”

“… Local, state and federal law enforcement agencies shall not be
organizationally affiliated, and persons or groups, therein, shall not
be presumed by law enforcement to be acting lawfully solely because of
such auspices.”

“… There shall be no discrimination against any law abiding Citizen,
business or organization due to arbitrary categorization. No public
nor private regulation shall require disclosure of a person’s stand or
vote on any issue which might cause them discrimination. Laws shall
respect the People’s diverse mores without setting arbitrary social
standards. No government shall criminalize behavior that the Public
considers to be innocuous, or is macro-typical, or where government
isn’t being deferential to the Public; nor shall they: prosecute
victimless crimes other than gross reckless endangerment; restrict the
freedoms of Citizens through oppressive laws and procedures; enact
laws too broad in scope to address narrow issues; pass laws
disallowing any reasonable criminal defense, or solely at a bureau’s
request; selectively or inequitably enforce any laws; impose unfair,
drastically different punishments due to one’s sex, race, color, creed
or age; nor sentence someone differently due to their having a prior
criminal record. An arresting officer may reverse such with impunity
at any time, regardless of the forms, procedures or processes begun.
The arrested person shall be freed and the record expunged. Agreeable
restitution to crime victims may, at their option, substitute for the
apt trial.”

“… 2nd & 3rd Amendments: Law-abiding, peaceable Citizens shall have
the right to keep and bear arms for sport or protection. Such may use
appropriate action—by degrees—to counter unlawful, forced or
threatening intrusion onto or into their private property, including:
verbal warning; the threat of; and then the use of, deadly force, if
necessary. Soldiers shall not be quartered in private residences not
their own unless the House assents.”

“… 4th Amendment: People, their motor vehicles, boats, possessions,
clothes, phones, computers and other personal or private effects shall
be secure in their houses, or other abodes, or on the associated owned
or rented property, or at their place of work against unreasonable
searches and seizures. Warrants may be issued only with just,
probable cause, supported by a recent eye witness’s oath or
affirmation, and particularly describing the place to be searched, and
the persons or things to be seized. No warrant shall be issued based
on supposition, chance or a presumed likelihood of finding evidence.
The obtaining or issuing of a warrant without just, probable cause is
a felony, as is the serving of a wrongful warrant by an armed
officer(s). Law enforcement shall not presume that a major crime may
have occurred or might be in progress because of a petty crime; nor
shall arrests be allowed that are due mainly to a person’s propinquity
to a crime. A person arrested without resistance who is not a suspect
in a provable crime of violence, may be searched, but not shackled, if
they voluntarily agree to transport themselves, or to be transported;
nor shall shackles nor prison clothes be used during the voluntary
transport of such person to or from a public proceeding or court.
Anyone who is arrested, detained, searched or has property seized
because of a warrant shall have a public warrant hearing within 24
hours. Such hearing, with competent counsel, shall be before the
judge issuing the warrant; the basis for issuing the warrant shall be
explained; all parties causing the warrant to be issued, including the
judge, shall be available for cross examination. The rationale and
constitutionality for the issuing of a warrant can, by right, be
appealed to a higher court(s). Evidence from unreasonable search or
seizure isn’t admissible in court.” …

*** VERY IMPORTANT: “… It shall be unlawful for law enforcement to
endanger the Public in the reckless pursuit of a real or supposed
wrongdoer, or to batter anyone already apprehended, or to allow
another to batter such person without restraint. No Citizen can be
stopped, detained, forced to show ID, nor required to explain any
activity—including running—without there being substantial proof of
their involvement in a felony. Petty crime commitment does not give
law enforcement license to make unreasonable searches nor seizures.”

Note: Blacks, in particular, have too often been battered, unfairly,
as well as forced to show I. D. Under my New Constitution, all Prof.
Gates would need to do is to calmly say: “Officer, this is my private
residence. I accidentally locked myself out. Please leave, or you are
in violation of my constitutional rights.” If the officer did not
leave, or he asked to show I. D., he would be guilty of a felony
carrying a minimum 3 yr. sentence.

In his first press conference following the (wrongful) arrest of
Professor Gates, Barack Obama said—most properly—that the police had
acted inappropriately. But Obama slipped-up by saying he didn’t have
all of the facts. The press cut-him-to-pieces for supporting the
property rights of a Black above those of a (dumb) policeman in a
“risky” profession. Rare, for me, I defended Obama’s correct ‘gut
reaction’. If Obama has done any other thing RIGHT in his lifetime, I
would be supportive of that act, as well. It was very sad to see how
he bent to pressure, as though police can do no wrong. No beer
drinking around a table could ever correct the unjust arrest of Gates.

At the end of ‘Face the Nation’, Bob Schieffer did an excellent job of
pointing out numbers of reasons why members of Congress aren’t
responsive to the Public Will. About six billion dollars was wasted
during the last election (mostly paid to consultants, pollsters, and
the media). That included 8 to 20 million dollars per senator. Most
of that money is “party” related, meaning: Those in office have
effectively been BRIBED to do their party’s bidding before they even
get a chance to consider… representing their electorates.

None of the Founding Fathers, nor anyone else alive today, has spent
more man-hours than me trying to put the USA on the right footing.
Please, People. If you love your country, tell your friends,
relatives and associates about a SC man who has penned and polished a
New Constitution that will—once-and-for-all—make government be
subordinate to the public. The FASTEST way to correct this country’s
problems, and to begin removing the financial burdens on our
grandchildren, is to ratify my New Constitution. Sending more good
people to Washington simply cannot get the job done...
