Again ... the Government INSERTED itself into marriage ... and subsequently INSERTED itself into the dissolution of same.
Government has no 'interest'. Government is unnecessarily involved.
Party A and Party B seek to 'marry' as their culture teaches. They present themselves to their 'community' and 'marry'. If their culture allows that 'marriage' to be dissolved, then they follow the course of that 'community'. If their culture does not allow that, then they leave THAT community for another that is more accepting (or allows them to do as they choose).
Government is not required. Furthermore, a 'court' or 'mediator' need not be associated with 'Government'.
[I was curious as to what Dershowitz was claiming]
