I am not a lawyer, but...
The website now has a terms of service document for how to use the NTP Pool --

The main points are about not configuring syncing in a dumb way (top of the
hour, too frequent, etc) and that the service is provided as-is -- don't use it
for anything where correct time is business- or life-critical.
That's a nice idea, but as the pool is clearly international, US law
will be useless for many here. In many cases US law simply will not
apply, no matter what you state in the ToS. I think for Germany stating
which laws apply is only possible when signing a contract with a
non-natural person (e.g. a company).

Add something similar to the front page, in probably most law systems
that I can imagine, this should be a lot safer than the ToS.
It should give all people that are looking for a reliable and stable
time source a clear indication that they should be looking elsewhere.
That should also allow Kurt to provide their package, as he only has to
repeat that statement and suggest that, if a user is not satisfied with
that, they need to look for other options.
As Jasper mentions, actually going into a binding contract is probably
the worst you can do for the pool, as that starts all the insecurities
regarding the laws that apply and how they should be interpreted.
Do not use legalise language more than needed, but if you do, make
sure it also protects the contributors. And that is an international
bunch. Not automatically bound by US law.
