Yes, but rules of war are based on the understanding that  your side may 
be losing at some point - so you agree to certain basic standards of 
treatment to the enemy, in the hopes that they will adhere to those 
standards when dealing with your people.  eg, "Don't kill our children, 
and we won't kill yours."   The implication is if they DO kill ours, 
we'll kill theirs.
