Not for distribution; you can link OpenSSL against RSAREF and get
something that is legal for noncommercial use.  It is apparently also
legal if you have any secure web server license to use any other one. 
Note also that the RSA patent expires in less than a year.

(Oh yes, the kerneli.org patches should have been on this list, too.)
