Then it means the packages can go into the free section which is dedicated to
FLOSS but forbidden in Fedora for some reason (out of tree kernel driver,
patent mainly).

Owning is fine is the sense that GPLv2 allows to make modifications either or
not they are accepted in the Intel source tree (still it's better if it's
accepted).
It will be even better when/if this driver is accepted in the upstream kernel
tree.
Do you know any reason why it's still out of the kernel tree ?
