I don't think the documentation says that. We don't measure RTAI
performance or track its development.

It can be used. Mr. Denk is unhappy that we do not allow  non-GPL use
of RTLinux, RTLinux derived code, or the RTLinux patent without charge.

This is not correct. While Linux kernel permits binary modules as an exception to
GPL, most other GPL projects require that any derived code be released under GPL.

Of course. As long as you follow GPL and the Open RTLinux Patent License.
The only issues are when you seek to combine closed source code with RTLinux/GPL
in which case, as with all such combinations of GPL and non-GPL code, it is 
wise to get legal advice.

FSMLabs currently supports RTLinux/Pro for 8xx and welcomes contributions of 
RTLinux/GPL for 8xx.
In fact, the major difficulty is not RTLinux, but a stable Linux for these processors.
