Because the ROM is a bit of a grey area - the contents of the ROM (the 
code) is copyrighted; it's treated as a language/artistic work.

The design of the ROM chip itself is patented - it's a design/piece of 
hardware.

You can patent furniture. You can even copyright it (if it's displayed 
in a gallery as a work of art). And you can trademark it - if you can 
come up with some way of doing so (such as "and with Cookie's Chair's 
Trademarked "s" curve design"), and you're selling it with that as a 
branding 'feature'.
