I fear that this modality is there to prevent some
sideeffect I'm not aware of. I checked into the code
recently and those windows do not check if they exist
already causing them to throw an excpetion if by any chance
the dialogue looses it's modality atribute.

I'll try to have a look again and try to understand why it
is declared modal at all. Could have been that you just say:
"AH this is an old issue it is tricky, indeed."
