It seems to be an article I procedure in which the Chief Justice of the Supreme Court is given the task of judiciating. It is not a normal function of an article III judge. Notice that there are article I courts and judges. They are usually considered administrative judges, such as those who hear Social Security claims and IRS courts. Territories, I believe were governed under the powers given to Congress in Article I. However, I do not think that this is under the law martial, but related in that both are Federal and originate in the powers given in the Article I of the Constitution. I don't know what kind of robe Rehnquist is wearing. Could someone describe it and the diffences between it and his normal robe? It may be that the robes they normally wear signify a different venue then what is taking place now. Venue is very important.
