Subsequently, either traditional or digital photographs are acceptable. Photographs are only accepted in the courts (Canadian, anyway) under the following provisos: 1) The photographer testifies that the photograph is an accurate representation of what was seen through the viewfinder. 2) The original negative is produced as evidence, and all people who handled the negative, from the moment it hit the lab for processing right down to the lawyers mistress swear that this is the negative used to produce the print being used as evidence, and that absolutely no manipulation of the image was done. Been there, gone to court for it. 3) Digital imaging, because of the lack of negative, and the ease with which seamless manipulations can be accomplished, have no legal standing before the courts. I first saw this photo some time ago, when it won the World Press prize for science photos, but it still knocks my socks off everytime is see it. I've taken shots of one fighter jet from another, and they are always difficult. This one is damn near perfect, and, of course, he was skillful enough (and perhaps lucky enough) to catch the "decisive moment." If fact, this picture could serve as a definition of the decisive moment! -- Daniel J.
