Original Message Subject: [Techhouse] Jetgroove Attorney Responds From: Lori Riegler-Namvar [EMAIL PROTECTED] Date: Fri, October 8, 2004 9:12 am To: [EMAIL PROTECTED] Dear Lori Rielger-Namvar, My name is Ulukman Mamytov and I am the attorney for jetgroove.com. I bring you apologies from JetGroove for making you worry about your copyrights infringements and your music repertoire being presented on our website. I want to assure you that jetgroove.com having started a new Online Music Download Service pursues the objective of making your music more wellknown and accessible and ONLY BY LEGAL MEANS. That means we DO NOT SELL any of your music without obtaining a proper permission (License) from you or other respective rightholders. You can easily check this by trying to purchase any of you music. Everything that you choose to put in your cart will have status: Not Available For Purchase Yet. It could only be put ON HOLD. And we do not change that status untill the contract is signed and your permission is granted. In this case all of your music will be given Allowed for Selling status and people who have it in their shopping carts will be able to buy it. The experince of showing your music on our website without distributing aimed to draw your attention to us, with further goal to make contacts with you on friendly terms with a perspective of mutually beneficial partnership. We're glad to inform you that your music is getting popular indeed through our website and we can let you know at any time how many of your tracks were put on hold and which ones. However, we deeply understand your concerns and would like to assure you, if you find our relationships impossible, we will IMMEDIATELY delete all of your music from our music collection. Hope you'll find our offer to make your music more popular through us rather reasonable and we can start that mutually beneficial partnership. Apologies if this offends anyone, but... You've hit the nail on the head. A contract with a Russian company is worth sh!t. It wouldn't surprise me if there's no music actually sitting on their computers at all - they may well have just populated their database directly from Discogs. The whole enterprise looks highly dodgy to me. I hope it doesn't indicate that sharky mp3 net entrepeneur types, scared off by the powerful and litigous RIAA and BPI, have decided to focus their attention on us poor and lawyer-less types in the underground/non-commercial world. In many ways the underground must look like easy meat compared to major label artists. It wouldn't surprise me if there's no music actually sitting on their computers at all - they may well have just populated their database directly from Discogs. nah, that might hold true except for the fact that they have more than a few tracks from artists that have never been released as well as a number of trax already released from netlabels (which are always free). smells like some snakes in the grass. also, It seems there've been some letters to the hosts. I'm pretty sure there are laws against hosting copyrighted material without permission in a general hosting contract. can anyone verify that they're offline or is it just me? looks like they've been taken down at the moment though... unless I'm wrong. It's clear what they are doing and it's fraud. They are trying to exploit people (labels/artists/punters) - hardly a great way to endear yourself to a label or artist, advertise their stuff for sale and then ask for permission, it just wrong... martin - Original Message - From: [EMAIL PROTECTED] To: 313@hyperreal.org Sent: Friday, October 08, 2004 7:23 AM Subject: Re: (313) [Fwd: [Techhouse] Jetgroove Attorney Responds] I've been thinking. Brendanhave decided to focus their attention on us poor and lawyer-less types in the underground/non-commercial world. In many ways the underground must look like easy meat compared to major label artists. Must say, it really does look like that might be the case. It's a shame, because the idea would be a honorable one in principle. I remember we had a conversation about this a while back, and the more knowledgable people on the list told me that this sort of thing was quite costly and difficult to do _ - End of message text Is your business ready for the new era of accounting? http://www.ifrs.co.uk This e-mail is sent by the above named in their individual, non-business capacity and is not on behalf of PricewaterhouseCoopers LLP. Re: (313) [Fwd: [Techhouse] Jetgroove Attorney Responds]
hmmm, just thought i'd add my two cents. the practice of this jetgroove website is highly questionable imho. i'd probably advice any labelowner to summon jetgroove to take all references to his/her label's releases off the website. basically jetgroove is trying to cash in on the fact that artists and labelowners have spend time, effort and money in getting their music out, and get noticed by the public. now jetgroove tries to generate attention to their PAID service making use of the hard work by other, whom have not given their prior permission. the fact that they place the names of artists and labels on their website, as if these artists and labels have granted permission, could possible even damage the good name and image of these artists/labels, should the practice of jetgroove turn out to be fraudulent or otherwise illegal. jurren _ MSN Search, for accurate results! http://search.msn.nl
