 addition to my routine practice of civil and criminal cases i also
 took special interest in the cases of the persons with disabilities to
 provide Justice in the Society.


 i was also an eminent person for dealing women Right issues, Gender
 Equality and participated in many conferences like the International
 Instrument for women, i.e., CIDA, and its effect in India at
 Bangalore.


 i was  nominated for NHRC and CHRC workshops held for the law persons
 all over India.  The training Programme was first at Bangalore Law
 School (6th July to 10th July) followed by other two workshops at
 NALSAR, Shameerpet, Hyd and Kerala Kochin Law School,  contributed
 several suggestions and recommendations for the amendment of the
 provisions on employment (articles 32 to 38 of Persons with
 disabilities  Act 95),  as one of the Law representative of the

Computer guru and futurologist Ray Kurzweil

A leading scientific “futurologist” envisions that the
pace at which scientific advancements are taking place
may lead to computers “matching human intellect
by the 2020s.”

American computer guru Ray Kurzweil reckons that there
will be 32 times more technical progress during the
next half century than there was in the entire
20th century.

While addressing the American Association for the
Advancement of Science (AAAS) in Boston, he said that
machines would rapidly overtake humans in their
intellectual abilities, and would soon be able to
solve some of the most intractable problems of the
21st century.

He revealed that his prediction was based on the
calculations that computer chips had been doubling in
power every two years for the past half-century.

“The rate is now doubling every decade, so the next
half century will see 32 times more technical progress
than the last half century. Computation,
communication,
biological technologies - for example, DNA
sequencing - knowledge of the human brain, and human
knowledge in general are all accelerating at an
ever-faster
pace, generally doubling price-performance, capacity
and bandwidth every year,” he said.

Kurzweil pointed out that computers had been based on
two-dimensional chips made from silicon to date, but 

scientists had developed techniques to create
three-dimensional chips with vastly improved
performances.

He said that 3-D chips could also be constructed from
biological molecules, which may enable them to be
miniaturised even more than metal-based computer
chips.

“Three-dimensional, molecular computing will provide
the hardware for human-level ‘strong artificial
intelligence’ by the 2020s. The more important
software
insights will be gained in part from the reverse
engineering of the human brain, a process well under
way. Already, two dozen regions of the human brain
have been modelled and simulated,” he said.

Kurzweil further said that computers were on their way
to creating a “post-human” world where a second,
intelligent entity would exist alongside people.

“Once machine intelligence matches the range and
subtlety of human intelligence, it will necessarily
soar past it 

because of the continuing acceleration of
information-based technologies, as well as the ability
of machines to instantly share their knowledge,” he
said.

“We are understanding disease and ageing processes as
information processes, and are gaining the tools to
reprogramme them. Within two decades, we will
be in a position to stop and reverse the progression
of disease and ageing resulting in dramatic gains in
health and longevity,” he added.

However, I am reproducing some paras below with suggestions embeded in brackets

decline. However strict adherence to this requirement cannot be stretched 
beyond a logical point. .[why not? and, what is the logical point

place, firstly because of reasons of decline in examination capacities of non 
students, and secondly to dispell the misconception resulting from giving 
lecturers etc. as scribes that blind students do receive an undue advantage.]]

Looking at the needs of each Disability, the Policy must cover as many issues 
as possible and not leave any ambiguities and lacuna. Basically it has to cover 
all questions raised by the officials of the Examining authority who tend to 
harangue the candidates just before the examinations.



2. Flexible and Dynamic



The implementers of the Policy have to be able to adapt to the situation. There 
may be a need to change the Scribe at the last minute or a Disability may arise 
while the exam Schedule is on for eg. A candidate may fracture his hand while 
returning from a paper and may need the use of a Scribe for the remaining 
papers. Also technology is evolving and needs to be taken into account. The 
discretion of the officials of the Examining authority has to be exercised 
keeping the best interest of the candidate in mind.

This Policy must be reviewed periodically after recording the experience of all 
concerned.



3. All Examinations



This Policy will apply to all examinations being conducted in India generally 
and specifically to examinations conducted by Educational institutions- schools 
and  colleges (both internal and external), School and College Boards, 
universities and deemed universities, autonomous bodies conducting entrance or 
promotional examinations as well as all recruiting/promoting  authorities and 
any other authorities or bodies under which a Disabled examinee wishes to 
appear for an examination for any purpose whatsoever.

Ironically, the same place holds the answers for all
of us. The most-used bookmark on my web browser
Wikipedia.org. According to its reference entry on
itself:

world is open to you. There’s even a wikipedia in
Romany (the Roma people, gypsies to you and me?)!

Alternatives for you

There’s no beating Wikipedia when it comes to arcane
and useful knowledge on the web. 
That is, except for HowStuffWorks.com. A site which
uses graphics and animation to explain the workings of
myriad objects (from jet turbines to lock picking),
HowStuffWorks also has sections on Health, Finance
(how credit cards work!), Travel and tons of other
stuff. 

You’ll have to check them out to really understand
that knowledge is within easy reach of the commoner,
and no longer the exclusive preserve of the specialist.

In the section 13.j.vi All the data on the Computer must be password
protected using the utility software called Folder Access. This software can
make any folder access limited by password.

Can we put it Folder Access as suggestion rather than a must? as there
might be other software which can do the same, making it to read as .

There may be a need to change the Scribe at the last minute or a Disability
may arise while the exam Schedule is on for eg. A candidate may fracture his
hand while returning from a paper and may need the use of a Scribe for the
remaining papers. Also technology is evolving and needs to be taken into
account. The discretion of the officials of the Examining authority has to
be exercised keeping the best interest of the candidate in mind.

This Policy must be reviewed periodically after recording the experience of
all concerned. 

 

3. All Examinations 

 

This Policy will apply to all examinations being conducted in India
generally and specifically to examinations conducted by Educational
institutions- schools and  colleges (both internal and external), School and
College Boards, universities and deemed universities, autonomous bodies
conducting entrance or promotional examinations as well as all
recruiting/promoting  authorities and any other authorities or bodies under
which a Disabled examinee wishes to appear for an examination for any
purpose whatsoever. 

 

The categorization of exams into exams conducted by educational institutions
and competitive exams is uncalled for. However there may be specific
requirements of each exam and these have been addressed in this Policy. 

 

4. Need for the facility of a Scribe

 

In a country like India which envisages for its citizen's equality of
opportunity, allows its Disabled to take exams but has denied on several
occasions its disabled examinees the use of a Scribe. This denial has let to
anomalous situations where a visually disabled examinee has been allowed to
appear in an examination but has not been allowed the use of the scribe
thereby effectively denying the visually disabled to appear in the
examination and better his prospects. The humanitarian and logical aspect of
providing a facility of a Scribe should not have been required to be spelt
out however since the ground level situation is such that the Disabled have
been discriminated against on such basic issues even this needs to be
clearly documented.

 

5. Entitled   

 

Categorizing of the Disabled persons who will be entitled to get the
facilities of a Scribe could be standardized to some extent.

Barcelona (PTI): World's largest cellphone maker Nokia has tied up with Google 
to facilitate web search on its products, even as it launched models offering
new services, moves that could consolidate its leadership position. 

The integration will begin in select markets on Nokia N96, Nokia N78, Nokia 
6210 Navigator and Nokia 6220 classic. Google search will be extended to 
additional
models in the future. 

Ultimately, Nokia will make Google search available to its customers in over 
100 countries around the world, serving mobile owners speaking more than 40
languages. 

At the GSM World Congress, the company also launched a number of new devices 
including phones that offer location- based navigation services. 

Nokia improved its market share to 40 per cent last year and hopes to better 
it. 

Launching four mobile phones -- N96, Nokia N78, Nokia 6220 and Nokia 6219 
Navigator, the company said these were no longer mobile phones but mini personal
computers. 

As we continue to free the internet from the limitations of the desktop, we 
are taking mobility into a completely new realm of possibility, Nokia Chief
Executive Officer Olli-Pekka Kallasvuo said. 

The devices exhibit different location-based and multimedia experiences from 
pedestrian navigation to geo-tagging and movie viewing to video and photo 
sharing.
The phones would be in the market from second quarter this year. 

Commenting on i-phones from Apple and other companies, Nokia officials said 
they were ready to face the competition. 

Nokia Executive Vice President (Mobile Phones) Kai Ostamo, while commenting on

Your communication and the way you present yourself are crucial in
formulating that first impression, so you want to make sure you're up
to par.
  If the image you want to project to the  world if that of the
switched-on savvy, and successful woman, so what should you ware to
work?
  Let's divide in to two extremes—creativve and conservative. At one
day of the spectrum you can face each day as if you were going to a
fancy dress party. At the other end, there's the more mature,
formalized  world of the professionals.
  For most of us, workware falls somewhere between the two extremes.
It's all about authority—call it power, influence and presence—how
much of it you have, and how much of it  you'd like to have.
  Here's some pointers to help you dress for success:
  1 Dresss Like you Are In Charge if you dress like you're in charge,
you'll feel like in charge and in control and others will see you that
way.
  Nothing says, I'am the one you need to talk to quicker than a
dark, well-cut suit. Note: well-cut does not include a shapeless box
with two sleeves and buttons. Remember, therre's a fine line between
looking tailored and looking like you're front-desk at a car rental
company.

  2 Keep It Low Key
  color is fine for the office, but don't overdo it. Leave colored
suits for newsreaders and politicians and save the color for the
piecies underrneeth the jacket. Perhaps a twin-set is appropriate in

Hi Friend,

In call center, a different software is used.  It is
known as CRM that is, Customer Relation Management. 
JAWS does not read the contents of the screen.  I
think we have to search for scripts which would enable
JAWS to read efficiently.

In that software, the Customer Care Executive enters
the details of the customer and gets the elaborate
details of that particular customer; for example, If
we call Airtel Customer Service, they will ask our
mobile number and our name.  As soon as they enter our
number and our name, they get details about our plan,
tariff, validity of the sim and so on.  I gave a deep
thought whether visually challenged can work in the
field.  Customer Care Executive speaks to the customer
and reads the contents on the screen simultaneously. 
On other hand, we have to listen to JAWS as well as
the customer.  The solution is to get script for JAWS
and braille display.  We can read the contents of the
screen by using our hands and talk to the customer
simultaneously.  We have solution but people have to
realise it.

What won you Nasscom's prestigious award for innovation this year?

 

Comat provides easy and affordable access to information-based government and 
business services in rural communities in India through our Rural Business

Centres (RBCs). Rural citizens dealing with the governments do not receive 
services they are entitled to, and have limited or no choice for financial and

educational services.

 

We have found three innovations to solve these fundamental problems.

 

Use technology to de-skill complicated tasks: Modelled after the best practices 
of user-friendly designs, we have created a much simpler interface for 
operators.

 

Identify corporate partners who will use the center to deliver services through 
the center using their own personnel: For e.g., a fertilizer company that

markets fertilizers and offers advisory services to farmers.

 

Identify high revenue activities for the computer platform in kiosks during 
off-hours: We currently deliver checque truncation services for US banks.

 

How long did it take to develop the award winning rural business centre? How 
does it work? How many people are benefited by this?

 

In Karnataka, nearly 800 RBCs were made operational in six months under the 
Nemmadi project. Last year, we served nearly 75 lakh rural customers and 
currently

provide government and business services to over 10 lakh citizens per month.

 

Ever since the start of this project in October 2006, there has been a 30 per 
cent increase in the demand for government services in Karnataka.

 

How difficult was the task? What hurdles did you face? How do you ensure 
connectivity in rural areas?

 

We faced a few major hurdles like human resource and cash management, working 
with multiple layers of the government, finding good investors and handling

customer expectations.

 

We have put in place innovative technological mechanisms for tracking employee 
attendance, grievance management and tracking of cash.

 

Connectivity is VSAT-based. We have found this to be most reliable so far.

 

What are your views on innovation in India? How important is innovation for a 
country like India?

 

I have come across a lot of innovation across the globe -- both good and bad. 
Innovations in pubic policy and in ways NGOs (non-governmental organisations)

function are encouraging. Unfortunately, there is also innovation in corruption 
and ways of breaking set processes and protocol.

 

As the economy progresses and younger minds become more aware, further 
innovative thinking will be spurred. I am also looking forward to alternate 
sources

where innovation can spring from SMEs, rural citizens and young entrepreneurs, 
rather than from traditional strongholds like universities.

 

What are the major rural projects Comat is working on?

 

We are focussing on starting RBCs in other states. We have tied up with 
coaching centres to provide CET (Common Entrance Test -- for admissions to

Can you help us understand the innovation that won you the prestigious Nasscom 
award?

out handsets with varied flavours of user interface and opens up big opportunity

What will be the benefits of this application?

Mango's solutions enable rich features that were hitherto available only on the 
high-end phone segment, and spawn multiple revenue streams for phone 
manufacturers,
application providers and operators.

How long did it take to develop the award winning application?

It's been more than one-and-a-half years, and still more feature addition and 
innovation work is going on. Initially I and Lekh [Joshi] started it, and
later Aniruddha, Sourabh and Manohar joined us to make a very good core team.

How difficult was the task? What hurdles did you face?

There were few different challenges which we have faced or are still facing: 
convincing people to dream along with us; convincing our partners to license
their mobile hardware platforms for our development and test; convincing people 
to pay for the evaluation license so we can continue work.

How do you see the market for mobile phones in India? Do you see the cost of 
handsets falling further?

I don't think anyone has any doubt about the market potential in India. It will 
be more to do with the usable features at the same cost especially for the
low cost mobile phones that should be the mantra.

What was the inspiration to start this company?

As a team we have built many phone models for large and small companies but 
urge to put power in low cost handset and if we can contribute in improving
common persons productivity and lifestyle.

What kind of hurdles did you face when you started your company? What are the 
challenges that you face now?

We had very little money in our bank accounts but once we started and everyone 
committed for it, things started falling in place.

Could you tell us about your company's growth over the years? What the reason 
behind naming the company Mango?

We wanted to keep company name simple and easy to remember and of course we 
also wanted to show the Indian identity.

What is your staff strength now? Do you plan to hire more people?

Ideally, there should be no limit on who is a scribe. What about those of us
who are taking professional exams? In many cases, the candidate will be hard
put to find a student in the same stream. Plus, there may not be a decline
in a person's ability to act as a scribe.

Yes, cheeting can and does take place but limiting the scribe is the wrong
mechanism to counter it. The mechanism to be used is invidulation.

  With its New India project, the Pratyasha Foundation aims to get Kochi city 
made disabled-friendly. It hopes that a movement will catch on throughout the 
nation for the sake of the disabled.These people are denied access to public 
places simply because of the absence of ramps or elevators that allows 
wheelchairs, says Simon George, managing trustee and chairman of the 
foundation. The foundation aims to make Kochi a model for disabled-friendly 
access. Once this is achieved, other cities and towns will follow the example, 
he says. The project will show how bus stops and the Collectorate building can 
be made disabled-friendly. Though the disability Act, 1995, stipulates access 
to public places for the disabled, it has been put into practice in few 
buildings. The Act calls for disabled-friendly bus stands, railway platforms, 
parks, public buildings and so on, but hardly any of these is built in such a 
manner.
  The foundation has taken up a challenge to create awareness among people and 
their representatives in the Assembly and Parliament to help the disabled 
realise their right to access. The new initiative was recently inaugurated by 
V.R. Krishna Iyer, former judge, Supreme Court. Railway platforms can be raised 
and ramps provided to take wheelchairs from one platform to another. The 
international terminal at the airport here does not have an aerobridge and the 
wheelchairs available are rusted. Developed countries have disabled-friendly 
infrastructure. A beginning has to be made somewhere, Mr. George says.

2. Examination Form/Application 

a. All Application Forms/Advertisements for exams should mention that a
Visually Disabled candidate will be allowed the use of a Scribe and
alternative formats will be provided. 

b. The examining authority should give a clear option in the
advertisement itself whether the examinee wishes the scribe to be
provided by the examination conducting body or he/she wishes to arrange
the scribe on his/her own.

c. The Examining authority at the time of advertisement/application
should also print the criteria/qualification for scribe to be followed. 

d. The application form should have a provision asking low vision
persons to indicate the requirement of question paper in large print.
The advertisement for examination as well as the application form should
also clearly mention that the low vision persons would be allowed the
use of magnifying glass.




[MA] Points b and c above should read differently. In point b use
advertisement/application. And in point c, clarify that the criteria
is simply reproduced from this policy with the specifics about stream
and candidate levels spelled out and the examination authority does not
have the power to change/modify/add any other specifications for the
scribe.


3. Scribes chosen by Candidate 
 

a. In case the candidate avails the services of his/her own
scribe/writer, the scribe/writer   should be one grade junior in
academic qualification than the candidate if from the same stream.
However, this condition shall not apply if the scribe/writer is from a
different stream.

b. For competitive examinations the scribe needs to be one level below
the eligibility criteria of the competitive exam in consideration.

c. For internal exams of schools and colleges the condition of the
scribe being one grade junior in academic qualification than the
candidate should not be enforced strictly as this would cause undue
hardship to the candidate and give rise to unviable solutions.   

[MA] Point b above is not correct for competitive exams. Competitive
exams are all about practice and studying about the subject at that
point. E.g. a person who has already finished MBA is not likely to be
able to help an MBA candidate more than a student still doing
under-graduation.
Point b is more valid for academic exams e.g. a student of B. Com. 3rd
year may be able to unduly help a student of second year. In either
case, cheating can be prevented by invigilation and this restriction
should be removed.




4. Scribes provided by Examining Authorities
 
a. Considering the practical problems, it is necessary that even if the
scribe is provided by the examination conducting authorities, at the
request of examinee, such authorities must ensure the competence of the
scribe/writer. If the scribe is provided by the examining authorities,
it should be ensured that the scribe is adequately qualified to
understand the questions and to explain them to the candidate. 

b. To ensure the competence of such a scribe provided, the following
conditions should be adhered to:

i.  as far as possible and practical, the scribe himself/herself
should be a current student;

ii. In any case, the time interval between when such a scribe ceased
to be a student himself/herself and the time he/she is acting as a
scribe should not be more than three years, because with the lapse of
time, natural abilities of a student like writing speed, taking
dictation and writing an examination efficiently in a specified time
frame, suffer a considerable decline. However strict adherence to this
requirement cannot be stretched beyond a logical point.

[MA] The last 2 conditions are applicable to academic exams only. For
exams in govt./corporate institutions like banks, it will be incorrect
to use a student as a scribe.



d. The Chief invigilator of the examination center should have
discretionary powers to accept last minute change of scribes under
exigencies.
[ma] Even if the required authority is not available for some reason
when this last minute change needs to be made, the scribe should be
allowed and the relevant authority can retrospectively review that the
scribe used was in accordance with this policy.


f. The letter approving the scribe should contain the following
information in writing:
i. The extra time given to the candidate 
ii. He shall be seated separately
iii. Contact address and phone number of competent authority should also
be printed for last minute change of scribe.
[MA] Institutions like DU have ambiguous and discriminatory rules about
when this letter can be issued. The policy here should require the
examining authority to clearly state this process in the
advertisement/application/examination rules and this requirement should
not be unjust e.g. one day before the exam in case of some DU exams and
a similar constraint in case of CAT for MBA.

I would suggest three additions:

1. Vh candidates should be allowed the use of scribe or computer and extra
time in all examinations conducted by recruiting agencies no matter whether
there is reservation for them or not.

2. The special examination rules for the vh candidates must be obligatory on
all boards, universities, recruiting agencies under direct or indirect
control of the central and state government.

3. Any time lost on account of verification of the scribe's eligibility,

The Policy for Examination of the Disabled


The Policy for the Examination of the Disabled envisages a tension free
environment for the Disabled before, during and after the Examination.
It is time that India had a comprehensive, standard but dynamic policy for
examination of the Disabled.



The need for a standard and comprehensive Policy throughout India for the
examination of the Disabled has been growing since:



  a.. Every year more and more Disabled candidates are appearing for various
examinations.
  b.. The kind of Disability that has to be considered has also been
increasing over the years.
  c.. Number of examining bodies has been increasing over the years


  a.. Various orders/judgments/directions have been passed by various
Courts/Commissions/Authorities that deal with the problem in piecemeal.


  a.. Various examination conducting authorities have different rules and/or
implement the rules in different ways.


  a.. Technology is improving and needs to be taken into account


  a.. The anxiety suffered by the examinees before and during the
examination has to be removed


  a.. Questions asked at written examinations and the examinations
themselves are varied and need to be answered in various ways.


  a.. Competition is increasing and the Disabled have to be given a level
playing field.


1. Comprehensive



Looking at the needs of each Disability, the Policy must cover as many
issues as possible and not leave any ambiguities and lacuna. Basically it
has to cover all questions raised by the officials of the Examining
authority who tend to harangue the candidates just before the examinations.



2. Flexible and Dynamic



The implementers of the Policy have to be able to adapt to the situation.
There may be a need to change the Scribe at the last minute or a Disability
may arise while the exam Schedule is on for eg. A candidate may fracture his
hand while returning from a paper and may need the use of a Scribe for the
remaining papers. Also technology is evolving and needs to be taken into
account. The discretion of the officials of the Examining authority has to
be exercised keeping the best interest of the candidate in mind.

This Policy must be reviewed periodically after recording the experience of
all concerned.



3. All Examinations



This Policy will apply to all examinations being conducted in India
generally and specifically to examinations conducted by Educational
institutions- schools and  colleges (both internal and external), School and
College Boards, universities and deemed universities, autonomous bodies
conducting entrance or promotional examinations as well as all
recruiting/promoting  authorities and any other authorities or bodies under
which a Disabled examinee wishes to appear for an examination for any
purpose whatsoever.



The categorization of exams into exams conducted by educational institutions
and competitive exams is uncalled for. However there may be specific
requirements of each exam and these have been addressed in this Policy.



4. Need for the facility of a Scribe



In a country like India which envisages for its citizen’s equality of
opportunity, allows its Disabled to take exams but has denied on several
occasions its disabled examinees the use of a Scribe. This denial has let to
anomalous situations where a visually disabled examinee has been allowed to
appear in an examination but has not been allowed the use of the scribe
thereby effectively denying the visually disabled to appear in the
examination and better his prospects. The humanitarian and logical aspect of
providing a facility of a Scribe should not have been required to be spelt
out however since the ground level situation is such that the Disabled have
been discriminated against on such basic issues even this needs to be
clearly documented.

do turnarounds. One such example is Vikram Dalmia of Kolkata, who turned his 
father's loss making business in to profit making, when he took over its reins. 
In all this one finds one more thing that blindness is just another 
characteristic of Vikram, and which is not a hindrance in whatever he wants to 
do. Listen to this man, the mettle in whose voice matches his personality.

 

Patrick Henry Hughes is yet another achiever. He is a determined young boy,who 
despite being born blind and, crippled  has the courage to achieve anything he 
sets his mind on. Patrick Henry Hughes is a pianist of high esteem.  Actor 
Abhinav Chaturvedi tells us more about this young boy of 19, who is much better 
off than many at his age.
