[AI] Views Invited: Legal issues in an insurance contract for people with disabilities.

Dear Scholars,

I would like this discussion to be restricted to legal points, except
when other points are equally important to substantiate the answers.
If the moderator permits and other members have no objections, then I
would love to see this matter being discussed on one other group which
I think has quality experts to deal with the matter, and the group is
We The PWD. So, cross-posting permission is sought in the matter.

I have been through the judgment passed in the matter of Vikas Gupta
vs. Union of India and Anr. when it was passed, and from what I
remember that the judgment was passed in terms of postal life
insurance in which the maximum amount with which the person with
disability can be insured and additional premium being charged by the
insurer on the ground of increased risk which can be incidental cause
for insurer to undertake his liability in the event of any loss being
caused were in issue. And from what I vaguely remember, the judgment
was based on English authorities, as there was no case-law available
as far as Indian judiciary is concerned. Though I don't remember the
grounds on which the judgment was ultimately passed.

Subsequently, the postal department issued the circular / notification
(not sure what was issued), removing both the conditions.

I will also be approaching LIC for a policy in coming months, and even
my agent has told me that additional premium will be charged, and the
seniors have also told the same verbally. I have not taken up this
issue in my individual capacity yet with the corporation directly. My
questions are as below:

1. The judgment did not settle the issue at once for all. As it was a
writ petition (remedy for an individual), and it confined to the
issuance of postal life insurance. So, though the judgment can be
treated as a good precedent, and the ratio can be relied upon for
arguing cases subsequently. But, can it be said to have binding effect
on all?

2. Even if the answer is in affirmative, then on whom the judgment
will have the binding effect? (Will it be restricted to those
considered as state under Art. 12) or, even the private insurers can
be brought under the realm of this judgment?

3. Apart from the grounds of discrimination and other similar grounds
which are constitutionally available, and considering the fact that
disability (except lunacy) is no bar when it comes to contracting
capacity and insurance contract is no exception for us, how do we
practically justify that disability will not affect the risk which is
being underwritten materially in case of the happening of an event due
to disability?

Important: Can we say that in such cases the principle of causa
proxima (the immediate cause of happening of the event) will apply
while deciding whether the insured's claim is allowed or not?

4. Keeping the fact in mind that life insurance is based on human
value concept, would other insurances be governed differently?

5. Lastly, in case of a mediclaim policy, can we say that the existing
disability and its effects which may happen in general subsequently,
be excluded and all other benefits be allowed? (In such cases, the
effects should also be clearly defined when policy is being issued).
This I think should be quite a good possibility.

[AI] Deaf-mute girls allegedly raped in Jaipur

In a shocking revelation of sexual assault, the staffers of a
residential therapy centre run by an NGO here have been allegedly
raping and thrashing deaf-and-mute orphan girls for the past one year
during their visits for speech therapy sessions. The girls, aged
between 12 and 17 years, reside at the Government Girls’ Home in
Gandhi Nagar here.

Five girls had recently complained to the Child Welfare Committee
through sign language during counselling sessions that they had been
sexually exploited and beaten by the staff members of Awaz Foundation
at Kanota near here, where they were regularly sent to stay for
education and speech therapy sessions.

Acting on a complaint by CWC chairman Ram Prakash Bairwa, the police
on Friday night arrested five persons, including the administrator of
the residential school, and found in their preliminary investigation
that two of the girls had been raped and others were thrashed and
mistreated.

The shelter home, where the girls are staying, had registered the
complaint on April 30 and reported the matter to CWC.

Jaipur Police Commissioner Biju George Joseph said the accused
arrested from various locations included school administrator Alpana
Daswani, assistant Geeta Vaibhav, warden Ashok Prajapat, clerk Suresh
Bairwa and security guard Mahesh Mali. Among them, Ashok and Suresh
have been booked on charges of rape and others for conspiring with the
main accused and beating the girls.

The Awaz Foundation is run with the support of the State Government’s
Social Justice Department. The victims had earlier tried to bring the
matter to the notice of the Foundation’s authorities to no avail.

After their latest visit to the therapy centre, the shelter home’s
warden reportedly noticed injury marks on their bodies and informed
the CWC with the complaint of physical abuse.

According to the police sources, preliminary investigation has pointed
to the possibility of one of the girls being pregnant. The medical
report of the victim was awaited for a final conclusion.

The incident sent shock waves in the State capital and activists
representing women’s groups and People’s Union for Civil Liberties
staged a massive demonstration outside the Girls’ Home on Saturday
demanding justice for the deaf-mute girls and foolproof security
measures for all inmates.

This option is working using Google Chrome  I was able to set basic
html as default view.

will come to know that I have removed him? My question was that, is

If it is the battery problem, you can check by replacing the battery.
It uses normal battery BL5C which is too common in nokia mobile
phones, just take battery of any nokia mobile having this battery and
check it whether behaves in the same way? if yes then there is some
other problem.

Hi All,

You can set basic HTML in all the 3 browsers. First you login to your
gmail account and than switch to basic HTML by pressing enter on
respective link. At the end you will find the link for setting basic
html under the heading called account settings.

life insurance if the policy is beginning from or after 2008.

We thank you for your letter dated 18th May, 2007 enclosing a copy of your
earlier dated 13th March, 2007.

Regarding the points raised in your enclosed letter we have to inform you as
under:
1.  It is not correct that we do not allow some of our plans such as
Jeevan Anand, Jeevan Chhaya etc.to the blind persons. We do not have any
restriction with regard to plan and term for the insurance cover.
The only requirement is that the person to be insured should be gainfully
employed which is one of our basic requirement for all whether they are
disabled or not disabled.

2.  It is also incorrect that Janashree Bima Yojana is not available to
the blind persons. It is a social  
security group insurance scheme and provides insurance protection to persons
below poverty line and marginally above poverty line provided they are
members of the approved occupational/vocational groups.

3.  It is also not correct that we charge extra premium while offering
insurance cover to the blind persons.

I have been through the judgment passed in the matter of Vikas Gupta
vs. Union of India and Anr. when it was passed, and from what I
remember that the judgment was passed in terms of postal life
insurance in which the maximum amount with which the person with
disability can be insured and additional premium being charged by the
insurer on the ground of increased risk which can be incidental cause
for insurer to undertake his liability in the event of any loss being
caused were in issue. And from what I vaguely remember, the judgment
was based on English authorities, as there was no case-law available
as far as Indian judiciary is concerned. Though I don't remember the
grounds on which the judgment was ultimately passed.

Subsequently, the postal department issued the circular / notification
(not sure what was issued), removing both the conditions.

I will also be approaching LIC for a policy in coming months, and even
my agent has told me that additional premium will be charged, and the
seniors have also told the same verbally. I have not taken up this
issue in my individual capacity yet with the corporation directly. My
questions are as below:

1. The judgment did not settle the issue at once for all. As it was a
writ petition (remedy for an individual), and it confined to the
issuance of postal life insurance. So, though the judgment can be
treated as a good precedent, and the ratio can be relied upon for
arguing cases subsequently. But, can it be said to have binding effect
on all?

2. Even if the answer is in affirmative, then on whom the judgment
will have the binding effect? (Will it be restricted to those
considered as state under Art. 12) or, even the private insurers can
be brought under the realm of this judgment?

3. Apart from the grounds of discrimination and other similar grounds
which are constitutionally available, and considering the fact that
disability (except lunacy) is no bar when it comes to contracting
capacity and

When Ninety per cent blind students abstain from opting Meths and
science after 8th and tenth, then how DU will teach these subjects to
them after a  gap?
I don't know how The Highest Court of the land will respond to SLP
filed by The Sambhavana.
But this FYUP seems is going to be implemented at any cost. UGC Boss
Ved Prakash has almost given Green go ahead and Mr Pallam Raju has
kept HRD aloof by citing non-interference principle in to the autonomy
of academic institution.
not only this, an open house for students and parants for seeking
counsling about FYUP  has been extended till 30th of this month.
Things are going to be very messy in upcoming semester at DU.

 introduction of FYUP in its present design in Delhi University and

 hardships, irreparable loss and exclusion. The major bone of
 contention was the introduction of compulsory foundation courses on
 science and maths without making proper arrangements, and absence of
 any reading material in accessible form.
 On May 8th 2013, Delhi HC had asked DU to file a report within a
 week’s time about the arrangements it is making for vision impaired
 students so that they can continue their studies within FYUP to be
 introduced from July 2013 onwards on an equal basis with others.
 However, instead of filing a report, on May 15th 2013, the advocate
 appearing for Delhi University produced in the Court a notification
 dated 14th May, 2013 constituting an Empowered Committee For making
 suitable modification in the curricula, mode of instruction and
 assessment keeping in mind the special needs of the students with
 disabilities. The court whilst expressed its deep concern towards DU’s
 failure to address these genuine issues of Disabled while framing the
 new structure and courses, and also asked what is the great hurry? But
 at the same time, it allowed DU to go ahead with the implementation of
 FYUP after getting empty promises from the Respondent that they will
 address the grievances of the Petitioner through the Empowered
 Committee. It asked the petitioner to represent its views before this
 empowered Committee of Delhi University. It directed the Empowered
 Committee To submit a report to the Vice Chancellor by 7th June 2013
 so that the Vice Chancellor could take a decision in respect of this
 report by 15th June, 2013. It also asked the University to file a
 report regarding The action taken on the basis of the order of this
 Court on the next adjourned Date i.e. July 3rd, 2013.
 However, unfortunately by refusing to stay the introduction of FYUP,
 the court has thus made the entire case in fructuous vide its interim
 order dated May 15th 2013. Once the admission process commences and
 adequate provisions for vision impaired students have not been made,
 it would become impossible for the University to revert back to the
 existing system of three years degree program. It would cause a number
 of hardships and irreparable loss to the thousands of other students
 and to about 800-1,000 visually impaired students. Since reversal by
 that time would become difficult, the writ petition fled before the
 Hon’ble High Court will become in fructuous. Obviously, making
 laboratories in 81 colleges of Delhi University accessible; training
 teachers to teach science and maths to blind students; preparing and
 approving bridge courses for vision impaired students; arranging for
 accessible reading material and assistive devices and learning aids
 Etc. are tasks that require concerted and planned efforts and this
 goal cannot be achieved within a month by a University which needs
 more than a month to even prepare such a report. The introduction of
 FYUP in its present form means that the norm and legal requirement of
 integrating the aspect of disability in the original planning itself
 will continue to be violated and the general practice of first
 planning new structures without any regard of disability and
 subsequently making some minor modifications or arrangements would
 continue to persist.
 If any subject is waived off specially for the Visually Impaired
 student in year 2013-2014 than there will be discrimination between
 Visually Impaired students who will get the opportunity to study all
 the subjects in future as the students will be on a higher footing
 compared to the Visually Impaired students who are seeking admissions
 for the 2013-2014. If instead of making adequate arrangements, these
 courses are waved

 I have been through the judgment passed in the matter of Vikas Gupta
 vs. Union of India and Anr. when it was passed, and from what I
 remember that the judgment was passed in terms of postal life
 insurance in which the maximum amount with which the person with
 disability can be insured and additional premium being charged by the
 insurer on the ground of increased risk which can be incidental cause
 for insurer to undertake his liability in the event of any loss being
 caused were in issue. And from what I vaguely remember, the judgment
 was based on English authorities, as there was no case-law available
 as far as Indian judiciary is concerned. Though I don't remember the
 grounds on which the judgment was ultimately passed.

 Subsequently, the postal department issued the circular / notification
 (not sure what was issued), removing both the conditions.

 I will also be approaching LIC for a policy in coming months, and even
 my agent has told me that additional premium will be charged, and the
 seniors have also told the same verbally. I have not taken up this
 issue in my individual capacity yet with the corporation directly. My
 questions are as below:

 1. The judgment did not settle the issue at once for all. As it was a
 writ petition (remedy for an individual), and it confined to the
 issuance of postal life insurance. So, though the judgment can be
 treated as a good precedent, and the ratio can be relied upon for
 arguing cases subsequently. But, can it be said to have binding effect
 on all?

 2. Even if the answer is in affirmative, then on whom the judgment
 will have the binding effect? (Will it be restricted to those
 considered as state under Art. 12) or, even the private insurers can
 be brought under the realm of this judgment?

Hi, if you really want to download videos only from youtube, free youtube 
downloader is a good option. For converting to audio, use free video to mp3. 
Internet download manager can download videos from every flash website but 
lacks accessibility. You need to use jaws cursor to find download this video 
link while the video is playing and I really find it annoying as it doesn't 
work many times. As of now, I started downloading videos on my iPhone which 
prevented this headache for me

Classic Shell update brings Windows Store apps support

This changed with the most recent release of
Classic Shell,
an Open Source program that is bringing back features to Windows that
Microsoft has removed. It is more than a start menu replacement, as it
can also take
care of Internet Explorer and Windows Explorer on systems it is
installed on. You can however select to only add or replace the start
menu on your system
if you prefer that.

When you have installed the latest version of Classic Shell or updated
your existing installation, you will immediately notice the new Apps
folder in the
start menu. The folder lists all Windows Store apps that are installed
on the computer. A click on one of the apps loads it just like any
other program
on the system.

Classic Shell recognizes new app installations or removals
automatically and changes the start menu accordingly to reflect those
changes so that you always
work with an up to date listing of apps in the start menu.

The search covers both classic programs and new Windows Store apps and
will display suggestions the moment you start typing. The programs
folder lists
all desktop applications installed on the system plus links to the
Windows Store to quickly open the store on the start screen.

You can remove or move the Apps folder in the program options if you
do not want it to be displayed in the start menu at all. The program
is versatile
in this regard, making available a number of options to change which
items the start menu displays. You can for instance use it to remove
shut down items
or system folders that you never use from the start menu.

The program maps the Windows-key to the start menu and
Shift-Windows-key to the original start screen of the Windows 8
operating system. You can change
that and other features in the - extensive - preferences the program
makes available. Here you can for instance change the start menu style
to Windows
XP, Vista or Windows 7, change the look and feel of the start menu
button, or change the skin of the start menu.

The integration of apps shortcuts in the start menu is a big step for
the project as it sets it apart from the majority of programs that aim
to bring the
start menu back to Windows 8. Definitely a step in the right direction
and something that moves the program right next to Start8 in terms of
functionality.

i am having a big problem in my computer. and expecting help from you all.

in windows xp or previous, taking the snap of screen was farely easy
step as if we want to take a snap, we just had to press printscreen or
alt+printscreen from our keyboard, and paste this snap on the paint
program and save. now in windows 7, i am having a problem, as i am not
be able to take a snap of any screen. this above keystroke is no
longer working.  as in practical assignment, we have to display step
by step procedure along with the snap. in windows 7, there is a
program include by default known as snipping tools   which can do
the job of taking snap of picture. but the main problem i am facing is
that i am not being able to use this program from the keyboard. so, i
was wandering that is there any third party software which can do the
same job and can also be used from keyboard? or if any one know the
procedure regarding taking snap of computer screen with sneeping tool
without using mouse, i would be very grateful, as i have to submit my
practical assignment on 26 may.

Makesure that you have the latest jaws script for latest skype.
2.
Press alt key then down ero to profile submenue then right ero and two times 
down ero press enter there.
Now press rute to jaws PC curser and go to sho full profile focus on S of 
show full profile and press left mouse key.

Now the full page is ready for your editing.

Dear Avinash,

You are absolutely right on all these points. Just one point, I want
to submit for your consideration. 90 percent blind have not simply
abstained from studying science and maths. They have been practically
excluded by never creating inclusive science learning environment and
infrastructure in schools. If this would not have been the scenario,
many of them would have and would study these discipline. Of course,
this choice should rest with the students, however, all those who want
to study a particular subject should not be excluded on grounds of
non-availability of necessary infrastructure and other supports.

 hardships, irreparable loss and exclusion. The major bone of
 contention was the introduction of compulsory foundation courses on
 science and maths without making proper arrangements, and absence of
 any reading material in accessible form.
 On May 8th 2013, Delhi HC had asked DU to file a report within a
 week’s time about the arrangements it is making for vision impaired
 students so that they can continue their studies within FYUP to be
 introduced from July 2013 onwards on an equal basis with others.
 However, instead of filing a report, on May 15th 2013, the advocate
 appearing for Delhi University produced in the Court a notification
 dated 14th May, 2013 constituting an Empowered Committee For making
 suitable modification in the curricula, mode of instruction and
 assessment keeping in mind the special needs of the students with
 disabilities. The court whilst expressed its deep concern towards DU’s
 failure to address these genuine issues of Disabled while framing the
 new structure and courses, and also asked what is the great hurry? But
 at the same time, it allowed DU to go ahead with the implementation of
 FYUP after getting empty promises from the Respondent that they will
 address the grievances of the Petitioner through the Empowered
 Committee. It asked the petitioner to represent its views before this
 empowered Committee of Delhi University. It directed the Empowered
 Committee To submit a report to the Vice Chancellor by 7th June 2013
 so that the Vice Chancellor could take a decision in respect of this
 report by 15th June, 2013. It also asked the University to file a
 report regarding The action taken on the basis of the order of this
 Court on the next adjourned Date i.e. July 3rd, 2013.
 However, unfortunately by refusing to stay the introduction of FYUP,
 the court has thus made the entire case in fructuous vide its interim
 order dated May 15th 2013. Once the admission process commences and
 adequate provisions for vision impaired students have not been made,
 it would become impossible for the University to revert back to the
 existing system of three years degree program. It would cause a number
 of hardships and irreparable loss to the thousands of other students
 and to about 800-1,000 visually impaired students. Since reversal by
 that time would become difficult, the writ petition fled before the
 Hon’ble High Court will become in fructuous. Obviously, making
 laboratories in 81 colleges of Delhi University accessible; training
 teachers to teach science and maths to blind students; preparing and
 approving bridge courses for vision impaired students; arranging for
 accessible reading material and assistive devices and learning aids
 Etc. are tasks that require concerted and planned efforts and this
 goal cannot be achieved within a month by a University which needs
 more than a month to even prepare such a report. The introduction of

Dear Amar,
1. No doubt that the Judgment was passed in response of Writ petition,
but it shall be applicable for every visually-impaired concerned. If I
remember correctly, it was treated as a PIL as well. However, every
wording of the ratio needs to be studied in a very careful manner.
Therefore, I see no reasons as to why the judgment should not be
applicable for all visually-impaired.

2. With regard to the second issue, I don’t think that this ruling
applies to private bodies. As far as I know, and you’re also well
aware, that writ of mandamus and certiorari can not be passed against
private persons.

3. 3rd looks to complex to me and hence I’d left to other experts.

4. I think your observations are correct on this.
