Blind student falls from train, hospital ignores him

MUMBAI: A 24-year-old visually impaired law student who fell from a local
train in Dadar has alleged that doctors at Sion Hospital did not treat him
for

nearly six hours, as he lay writhing in pain on a stretcher in the corridor
of the casualty ward without so much as a bedsheet to cover him.

 Govind Mahaliya suffered two fractures on his right leg after falling off
the coach reserved for handicapped and cancer patients of a CST-bound local

that had started moving before he could alight completely. The first-year
student of Government Law College was on his way to their Churchgate hostel
when

the incident took place around 9.30pm on Sunday. A few ticket checkers and
other passengers rushed to his rescue.

 He was taken to the emergency medical room on platform six, where the
doctor-on-duty administered painkillers and dashed him to Sion Hospital in
an ambulance.

 "I was in too much pain to understand what was happening. The railway
police made a phone call to my friends," Mahaliya told TOI. "There was no
urgency

shown to treat me. The casualty area is so cold that I was shivering
throughout. But no one bothered to fetch me a blanket or even a sheet," he
said.

 The Rajkot resident said his college friends, who are his only support in
the city, made it to the hospital within 15 minutes of being informed by the

Government Railway Police (GRP). "When we arrived, he was being prepared for
an x-ray, which was eventually taken around 10.43pm," said Vaibhav Sangya,

one of his friends.

 The x-ray revealed that he had fractures of the fibula and tibia. The
doctors then approached his friends saying he needed a surgery immediately
and that

they should arrange for the money. One of Mahaliya's doctor friends, who
rushed to the hospital, started asking the resident doctor about the
diagnosis

and treatment plans. "I got rude answers. They gave us options of two
implants with varying costs. Soon after, they started insisting on Rs 5,000
for the

operation theatre," said the doctor friend who did not wish to be named. The
family, in the meantime, started hunting for private nursing homes given
that

doctors at Sion did not give him any treatment till 3am.

 Mahaliya claimed that suddenly at 3am he was informed that surgery was not
required. "We were told that the surgery was delayed till Monday," he said.

The ordeal did not end here. The family started insisting on admitting the
patient to which Mahaliya claimed the doctor said that things work at a
slower

pace in public hospitals.

 His friends managed to arrange for a bed after much nagging around 4.30am.
"We were curtly told to shift the patient from the the college building's
casualty

ward to the hospital building's orthopedic ward on the third floor on our
own. There were no ward boys around," said Sangya.

 Mahaliya claimed he was not seen by any senior doctor till Monday evening.

 Head of orthopedic department Dr Arvind Goregaonkar, though, said that
emergency surgeries are never delayed for implant or OT payment. "Patients
are

kept in the casualty area as it is fully equipped with doctors, diagnostic
facilities and the OT for any emergency." He added that tibia and fibula
fractures

can be operated even after seven days with good results. Dean Dr Avinash
Supe also said there was no delay in attending to the patient. "He will be
operated

in a few days," said Supe.

India has 20.42 lakh disabled children aged between 0 and 6 years.
Around 71% of them - 14.52 lakh children - are in rural areas. There
are 5.9 lakh disabled children in cities. Of them, 11.04 lakh are male
and 9.38 lakh are female children. Among them, 1.49 lakh children have
multiple disabilities.

Children with hearing and eyesight disabilities form the lion's share
among them. All age groups put together, there are more than 41 lakh
children with eyesight problems and 47 lakh children with hearing
disabilities in the country, says the latest report on 2011 Census
released on Monday.

"More children with disability are found in rural areas because of
lack of paediatricians in villages. Many community health centres in
rural areas don't have even a doctor, leave alone paediatricians,"
said chairman and founder of Narayana Health Dr Devi Prasad Shetty.
"Only a paediatrician will be able to detect disability in a child at
an early stage. If detected on time, the child can be sent to urban
centres to consult specialists," he said.

"Even many years after independence, in many villages, women give
birth with the help of midwives and not under a gynaecologist's care.
Problems that a pregnant woman faces affects the child also. At times
they are born with mental disability," Shetty said.

There are more than 5.80 lakh children in this age group with other
disabilities like autism and cerebal palsy. Uttar Pradesh has the
maximum number of children with disabilities. Bihar is next on the
list with 2.90 lakh children. Maharashtra has 2.17 lakh children with
disabilities. In the south, undivided Andhra Pradesh has 1.27 lakh
children, followed by Karnataka - 92,853 - Tamil Nadu - 62,538 - and
Kerala - 26,242.

Among the smaller states, Sikkim has the lowest number (628) of
disabled children. Assam has the maximum number of disabled children
(35,742) in the northeast.

"State governments should take steps based on census numbers. Even in
Tamil Nadu, the state government has not taken any step like incidence
analysis based on the 2011 census," said Meenakshi Balasubramanian of
Equals, an NGO working with disabled people in the state.

The country's disabled population has increased by 22.4% between 2001
and 2011. The number of disabled, which was 2.19 crore in 2001, rose
in 2011 to 2.68 crore - 1.5 crore males and 1.18 crore females. Rural
areas have more disabled people than urban areas. In Maharashtra,
Andhra Pradesh, Odisha, Jammu and Kashmir and Sikkim, the disabled
account for 2.5% of the total population, while Tamil Nadu and Assam
are among those where the disabled population is less than 1.75% of
the total population.

[AI] [Press Information Bureau] guidelines for issue of an excise duty concession certificate on purchase of cars by the physically handicapped

This press release denotes that this concession is availlabel only to
physically handicapped persons. 

 

 

This information was given by Minister of State in the Ministry of Heavy
Industries and Public Enterprises, Shri G.M. Siddeshwara in a written reply
in

Lok Sabha today. 

 

Concession on Excise Duty for Differently Abled 

 

Department of Heavy Industry has framed guidelines for issue of an excise
duty concession certificate on purchase of cars by the physically
handicapped

person. As per the guidelines, the applicants are required to submit the
following three documents:  

 

I. The handicapped applicant produces a medical certificate from the Medical
Officer of a Government Hospital,  in the prescribed proforma.  

 

II. The handicapped person produces a certificate from the manufacturer of a
passenger car to the effect that a booking has been made with them and that

the passenger car to be delivered to the handicapped person has specifically
been designed or fitted with special control devices or gadgets, depending

upon the type of disability of the person, such as auto transmission, grip
assembly, accelerator pedals, hand control, etc. fitted in the vehicle
depending

upon whether the disability is in right/left arm or in both legs or in
combination.   

 

III. The applicant gives a Self - certification that he had not availed of
this concession in the last 5 years and that he will not dispose of the car

with excise duty concession after purchase for a period of 5 years.  

 

IV. The total number of physically handicapped customers who have been
supplied cars on concessional rate for the last three years including
current year,

State-wise, including in Tamil Nadu, is annexed.

The results of the Assembly elections 2014 on Tuesday may be a
watershed for the state, but the outcome may not make any difference
to a section of the electorate - the disabled.

Issues that concern parents of special children as well as disabled
adults - both voting populations - hardly featured on any political
party's manifesto, campaign rally or speech.

Only the BJP mentioned implementing the 3 per cent job reservation for
the disabled on its manifesto, but every party had stayed silent on
inclusive education for special children.

According to Jharkhand Education Project Council, only 66.68 per cent
children between the ages of six and 14 years with special needs have
been enrolled in Jharkhand's government and private schools. Only 600
government teachers have been given basic orientation on inclusive
education with stress on special children's needs.

The situation is no better in private schools, as Circular 45 of CBSE
where certain assistance for children with disabilities is enshrined,
is not followed.

As far as adults with disabilities go, the state promises 3 per cent
job reservations on paper but can't guarantee this on the ground.

The state's apathy towards the disabled can be gauged from the fact
that the post of disability commissioner has been lying vacant since a
year, ever since Satish Chandra's retirement.

Recently, speaking to The Telegraph, Chandra had said: "I had
requested a few political parties to include inclusive education and
reservation for the disabled in their manifestos. Most children with
disabilities remain out of school, their parents don't get the Rs 400
monthly allowance meant for them. Inclusive education is important as
students learn to live, learn, play and grow with others. There are
national and state policies for inclusive education but the mechanisms
to implement them must exist."

Abhinav Kumar, in-charge of JEPC's inclusive education wing, agreed:
"We need to strengthen inclusive education as disabled children don't
get all the benefits they are entitled to. We hope the new Jharkhand
government forms a road map to connect the disabled to the social
mainstream."

Rahul Mehta, the director of Chotanagpur Sankritik Sangh, a social
organisation, who played leading role in drafting Jharkhand State
Disability Policy that was approved in 2012 by the state government,
said the plan of action was still pending.

"The policy aims to empower disabled persons through education and
social security. But, the benefits aren't trickling down to people.
Most political parties aren't aware of acts, policies and schemes
meant for the disabled," Mehta said.

Himachal court notice over facilities for blind students

Shimla, Dec 23 (IANS) A bench of Chief Justice Mansoor Ahmad Mir and
Justice Tarlok Singh Chauhan has issued notice to the chief secretary
and the principal secretary (education) of Himachal Pradesh regarding
the status of special facilities for blind students.


The notice was also issued to the director (higher education) and the
Himachal Pradesh University (HPU) vice chancellor Monday after a
visually impaired student wrote to the chief justice of the high
court, urging him to ensure that special facilities are provided in
all educational institutes of the state.

"There is no facility in schools and colleges for blind students. I
suffered a lot. I have seen that the HPU in Shimla is also lacking
it," Banita Rana, pursuing her master's degree in English, said in the
letter.

Taking cognisance of her letter, the court directed the top officials
to file replies within a week and listed the matter for hearing Dec
31.

Citing the Supreme Court judgment March 26, 2014, she said the court
had asked all the states to implement the Persons with Disabilities
(Equal Opportunities, Protection of Rights and Full Participation) Act
of 1995 by the end of this year. But nothing has been done to protect
the rights of people with disabilities.

Volunteers to protect Pakistan's Punjab institutions

Islamabad, Dec 23 (IANS) A three lakh-strong volunteer force will be
formed to provide security at educational institutions across Punjab
province in Pakistan.


A large number of volunteers were being gathered to counter the threat
stemming from terrorism at education institutions, The News
International reported Tuesday citing Punjab Education Minister Rana
Mashood.

This came after law enforcement agencies here identified 1,159
educational institutes in the Pakistani capital as soft targets for
terrorists.

On Dec 16, the Tehreek-e-Taliban Pakistan (TTP) massacred more than
140 students and teachers in an attack on the Army Public School at
Peshawar.

Mashood further said a meeting of the administrations of education
institutions has been called for Wednesday.

Mashood added that the entire nation had stood up against terrorism
and the government was not solely responsible for countering this
menace.

"First we listened to the Taliban, then we launched Operation
Zarb-e-Azb and now we all need to be on the same page," Mashood said.

Mashood also informed the media that a report pertaining to corruption
in the Punjab Education Foundation will be sent to Chief Minister
Shahbaz Sharif in a few days.

Issues that concern parents of special children as well as disabled
adults - both voting populations - hardly featured on any political
party's manifesto, campaign rally or speech.

Only the BJP mentioned implementing the 3 per cent job reservation for
the disabled on its manifesto, but every party had stayed silent on
inclusive education for special children.

According to Jharkhand Education Project Council, only 66.68 per cent
children between the ages of six and 14 years with special needs have
been enrolled in Jharkhand's government and private schools. Only 600
government teachers have been given basic orientation on inclusive
education with stress on special children's needs.

The situation is no better in private schools, as Circular 45 of CBSE
where certain assistance for children with disabilities is enshrined,
is not followed.

As far as adults with disabilities go, the state promises 3 per cent
job reservations on paper but can't guarantee this on the ground.

The state's apathy towards the disabled can be gauged from the fact
that the post of disability commissioner has been lying vacant since a
year, ever since Satish Chandra's retirement.

Recently, speaking to The Telegraph, Chandra had said: "I had
requested a few political parties to include inclusive education and
reservation for the disabled in their manifestos. Most children with
disabilities remain out of school, their parents don't get the Rs 400
monthly allowance meant for them. Inclusive education is important as
students learn to live, learn, play and grow with others. There are
national and state policies for inclusive education but the mechanisms
to implement them must exist."

Abhinav Kumar, in-charge of JEPC's inclusive education wing, agreed:
"We need to strengthen inclusive education as disabled children don't
get all the benefits they are entitled to. We hope the new Jharkhand
government forms a road map to connect the disabled to the social
mainstream."

Rahul Mehta, the director of Chotanagpur Sankritik Sangh, a social
organisation, who played leading role in drafting Jharkhand State
Disability Policy that was approved in 2012 by the state government,
said the plan of action was still pending.

"The policy aims to empower disabled persons through education and
social security. But, the benefits aren't trickling down to people.
Most political parties aren't aware of acts, policies and schemes
meant for the disabled," Mehta said.

You are right this Govt's priorities are very different. A lady doctor has
been attacked with acid.Perhaps another blind person in the offing. This
happens in a VIP market. What governance are we talking about! I do not

Well, if a story demands a blind beggar, then it is ok to do so. 

But what we want is a richer depiction of persons with disabilities. So there 
are blind adventurers, software professionals, teachers and trainers, lawyers, 
Marketing professionals, financial professionals, NGO professionals, 
entrepreneurs, beggars etc.

The above list is not exhaustive, so please excuse me if I missed anyone. but 
what I mean is that there should not be a single story about disability. It 
should be multidimentional. It should be about our day to day life with or 
without disability.  

And one more point, the picture is not complete without showing a blind or 
person with another disability as a legitimate romantic partner. Often people 
with disabilities are either seen as totally useless or so exhaulted that 
ordernary social life is not possible.

To make that posible, we have to live our life under regular circumstances. We 
need to be doing stuff that others do such as shopping, excersising, going for 
trips, raising kids and being romantic!

Appologies to mention that again, covert affairs also shows the blind techy guy 
interested in girls same as any other guy could have been. I am yet to see 
similar role for a blind girl! Oh no, lafangey parindey was close.

I couldn’t agree with you more! It is so important to interact and
engage  with the larger community that exists. We as the community of
Persons with Disabilities, are extremely marginalised, and given the
lack of access and infrastructure are mostly confined to the indoors.
This makes us and our issues even more invisible.  The larger quote
unquote normal population hardly know anyone or anything about our
lives, which leads to stereotypes being perpetuated. The only way we
can change and bring about a lasting social transformation is through
social contact, which increases empathy. Towards this we at Adventures
Beyond Barriers Foundation, aim to promote adventure and outdoor
sports for PwD’s and able bodied individuals together. Our initiative
has been able to reach out to large audiences in the public sphere and
has helped not only PwD’s come out and play and participate  as equals
and at the same time changed perceptions and built lasting friendships
between the two groups.

Madhumitha, please don't blame anybody unnecessarily.
Neither BJP is involved in any event of conversion, nor the central government.
We should give the new Jharkhand government a chance to proov its
sensitivity and efficiency towards the disability sector.
The demands of banking employs are different from those of the
disabled, so we shouldn't club them together.
Also, we can't use the same yardstics for both.
And, always remember, that nobody can satisfy everybody.
We should only ensure that the governments give their 100 % to the disabled.

I'm totally confused. I've seen also many orthopadically handicapped, many 
ladies with small kids, are also begging in local trains and traffic 
signals. Still, why only we blind are being noticed and being shown in many 
of the movies?

Well, if a story demands a blind beggar, then it is ok to do so.

But what we want is a richer depiction of persons with disabilities. So 
there are blind adventurers, software professionals, teachers and 
trainers, lawyers, Marketing professionals, financial professionals, NGO 
professionals, entrepreneurs, beggars etc.


The above list is not exhaustive, so please excuse me if I missed anyone. 
but what I mean is that there should not be a single story about 
disability. It should be multidimentional. It should be about our day to 
day life with or without disability.


And one more point, the picture is not complete without showing a blind or 
person with another disability as a legitimate romantic partner. Often 
people with disabilities are either seen as totally useless or so 
exhaulted that ordernary social life is not possible.


To make that posible, we have to live our life under regular 
circumstances. We need to be doing stuff that others do such as shopping, 
excersising, going for trips, raising kids and being romantic!


Appologies to mention that again, covert affairs also shows the blind 
techy guy interested in girls same as any other guy could have been. I am 
yet to see similar role for a blind girl! Oh no, lafangey parindey was 
close.

Madhumitha, please don't blame anybody unnecessarily.
Neither BJP is involved in any event of conversion, nor the central 
government.

We should give the new Jharkhand government a chance to proov its
sensitivity and efficiency towards the disability sector.
The demands of banking employs are different from those of the
disabled, so we shouldn't club them together.
Also, we can't use the same yardstics for both.
And, always remember, that nobody can satisfy everybody.
We should only ensure that the governments give their 100 % to the 
disabled.

Cheda Oraon, a polio-stricken youth, on his way to a polling booth in

The results of the Assembly elections 2014 on Tuesday may be a
watershed for the state, but the outcome may not make any difference
to a section of the electorate - the disabled.

Issues that concern parents of special children as well as disabled
adults - both voting populations - hardly featured on any political
party's manifesto, campaign rally or speech.

Only the BJP mentioned implementing the 3 per cent job reservation for
the disabled on its manifesto, but every party had stayed silent on
inclusive education for special children.

According to Jharkhand Education Project Council, only 66.68 per cent
children between the ages of six and 14 years with special needs have
been enrolled in Jharkhand's government and private schools. Only 600
government teachers have been given basic orientation on inclusive
education with stress on special children's needs.

The situation is no better in private schools, as Circular 45 of CBSE
where certain assistance for children with disabilities is enshrined,
is not followed.

As far as adults with disabilities go, the state promises 3 per cent
job reservations on paper but can't guarantee this on the ground.

The state's apathy towards the disabled can be gauged from the fact
that the post of disability commissioner has been lying vacant since a
year, ever since Satish Chandra's retirement.

Recently, speaking to The Telegraph, Chandra had said: "I had
requested a few political parties to include inclusive education and
reservation for the disabled in their manifestos. Most children with
disabilities remain out of school, their parents don't get the Rs 400
monthly allowance meant for them. Inclusive education is important as
students learn to live, learn, play and grow with others. There are
national and state policies for inclusive education but the mechanisms
to implement them must exist."

Abhinav Kumar, in-charge of JEPC's inclusive education wing, agreed:
"We need to strengthen inclusive education as disabled children don't

would be no modifications in a vehicle for us because we shall b using
