“intentionally insults or intimidates with intent to humiliate a
person with disability in any place within public view”
Does the above line means that if a PWD is insulted publically only
then it is an offence, or even if a PWD is insulted by close
relatives/friends/neighbours etc., not publically but personally, then
will it be an offence as per RPD Act? Experts please clarify!

[AI] Daily Eyeway Alerts

2020-10-14 Thread Ritu Jain
Dear All,
Please find the below Daily Eyeway Alerts:
1. News-
App to help ease accessibility issues differently abled face in
buildings, transport system
The ministry of social justice and empowerment is set to launch a
mobile application which will allow the differently abled, elderly and
even Covid-19 patients to lodge accessibility-related problems in
buildings or transport infrastructure by simply clicking and uploading
pictures from their mobile phones.
Sugamya Bharat app is part of the ministry’s efforts to ensure a
barrier free environment in government and other buildings as well as
transport systems.
In a letter dated October 7, the department of empowerment of persons
with disabilities secretary, Shakuntala Doley Gamlin, has said that a
decision was taken by the prime minister’s office in July 2019 for
crowdsourcing a mobile app to enable persons with disabilities to
register their complaints regarding access to places by uploading
photographs.
She said the Sugamya Bharat app would allow public participation in
such issues faced by not just the differently abled but also pregnant
women, children, and those who are temporarily disabled owing to
illness, surgery etc.
The department has also made a provision in the app for registering
Covid-related issues, the official said in the letter.

[AI] Lodge FIR Against Khushboo Sundar for Insulting remarks

2020-10-14 Thread National Platform For The Rights of the Disabled
October 14, 2020

*Press Statement*

The Tamilnadu affiliate of the National Platform for the Rights of the
Disabled (NPRD), is lodging police complaints in all districts of Tamilnadu
seeking lodging of FIRs against film actress turned politician Khushboo
Sundar for insulting & humiliating persons with disabilities.

Speaking to the media on October 13, 2020 at the Chennai airport, Smt.
Sundar has used derogatory terms like “mentally retarded” to attack the
party she left. This has been widely reported in the media and Smt.
Khushboo Sundar has not denied having made the remark.

While Khusbhoo Sundar has every right to politically take on her opponents,
usage of terms that invoke a negative portrayal of disability are
unacceptable. Time and again people holding public offices tend to invoke
such negative terms to tarnish the image of political opponents, lending
them legitimacy. This cannot be tolerated.

The National Platform for the Rights of the Disabled (NPRD) strongly
condemns the insensitive remarks made by Sundar.

The country and people like Kushboo need to be reminded that such insults
and humiliation are also prohibited by law. As per Section 92 (a) of the
Rights of Persons with Disabilities Act, 2016, “Whoever”, “intentionally
insults or intimidates with intent to humiliate a person with disability in
any place within public view” shall be “punishable with imprisonment for a
term not less than six months but which may be extended to five years and
with fine”. The Tamilnadu Association for the Rights of All Types of
Differently-Abled & Caregivers is seeking registration of FIRs against her
invoking these provisions.

Proceeding against high profile people should act as a deterrent and would
help in sending across the message that insult and humiliation of the
disabled and their negative portrayal would to be tolerated.
