 My opinion is as follows:

 1. Unless CCPD issues recommendations under Section 75B to government
authority, then only a government authority has a right to reject such
recommendations within 90 days by giving reasons for rejection in writing.
Accordingly, any directions issued under Section 75 read with Section 77
against every establishment which includes government and private are
 binding as directions.

 2. CCPD does have power to impose fines under Section 89, summon
officials, demand for production of records, and so on. But till date I am
not aware of any instance where CCPD would have imposed a fine on anyone.

 3. CCPD's power to report to parliament is quite broad, but I am not
aware if they have utilised the power in any specific instance.

 4. It is up to us to see how to have companies ensure compliance. And
we will not drop the ball on this one as well.

 Amar Jain

Re: [AI] CCPD issues range of directions to Ola Cabs paving the way for disability inclusive behavior by cab aggregators

2024-05-17 Thread Misbah
Ccpd directions/orders are recommendatory in the nature. parties may comply to obey its moral authority, or they may choose to not to comply at all. according to. RPD act ccpd has to submit a comprehensive report on annual basis at the floor of the Parliament. This is a near lip service. Sorry to say no one in Parliament  take notice of it.Sent from my iPhoneOn 17 May 2024, at 5:51 PM, Cauvery Krishna wrote:This is the issue of you lawyers. On Fri, 17 May 2024, 17:46 Amar Jain, wrote:I think I typed quite simple language. On this there could be different legal opinions.

My opinion is as follows:

1. Unless CCPD issues recommendations under Section 75B to government authority, then only a government authority has a right to reject such recommendations within 90 days by giving reasons for rejection in writing. Accordingly, any directions issued under Section 75 read with Section 77 against every establishment which includes government and private are binding as directions.

2. CCPD does have power to impose fines under Section 89, summon officials, demand for production of records, and so on. But till date I am not aware of any instance where CCPD would have imposed a fine on anyone.

3. CCPD's power to report to parliament is quite broad, but I am not aware if they have utilised the power in any specific instance.

4. It is up to us to see how to have companies ensure compliance. And we will not drop the ball on this one as well.

Amar Jain

Parliamentary reporting mechanism is not a right for us, it is a prerogative of the CCPD to be used where they feel that despite direction if there has been non-compliance in specific instances or even in general.

Does this answer your question?

I would like to know why would it be reported to the parliament? Can you explain the hierarchy of CCPD? For example in  usual cases there is trial court then a high court then the Supreme court.

On this there could be different legal opinions.

My opinion is as follows:

1. Unless CCPD issues recommendations under Section 75B to government
authority, then only a government authority has a right to reject such
recommendations within 90 days by giving reasons for rejection in writing.
Accordingly, any directions issued under Section 75 read with Section 77
against every establishment which includes government and private are binding
as directions.

2. CCPD does have power to impose fines under Section 89, summon officials,
demand for production of records, and so on. But till date I am not aware of
any instance where CCPD would have imposed a fine on anyone.

3. CCPD's power to report to parliament is quite broad, but I am not aware if
they have utilised the power in any specific instance.

4. It is up to us to see how to have companies ensure compliance. And we will
not drop the ball on this one as well.

Regards,

Amar Jain

Re: [AI] CCPD issues range of directions to Ola Cabs paving the way for disability inclusive behavior by cab aggregators

2024-05-17 Thread Amar Jain

On this there could be different legal opinions.

My opinion is as follows:

1. Unless CCPD issues recommendations under Section 75B to government
authority, then only a government authority has a right to reject such
recommendations within 90 days by giving reasons for rejection in
writing. Accordingly, any directions issued under Section 75 read with
Section 77 against every establishment which includes government and
private are binding as directions.

2. CCPD does have power to impose fines under Section 89, summon
officials, demand for production of records, and so on. But till date I
am not aware of any instance where CCPD would have imposed a fine on
anyone.

3. CCPD's power to report to parliament is quite broad, but I am not
aware if they have utilised the power in any specific instance.

4. It is up to us to see how to have companies ensure compliance. And we
will not drop the ball on this one as well.

Amar Jain

Parliamentary reporting mechanism is not a right for us, it is a
prerogative of the CCPD to be used where they feel that despite
direction if there has been non-compliance in specific instances or
even in general.

Does this answer your question?

that if someone is reaching out to any of the member and if they don't like the
same they should act like an adult and block the person instead of makibg a cry
on the group that this person messaged me and remove them from here etc.

Re: [AI] CCPD issues range of directions to Ola Cabs paving the way for disability inclusive behavior by cab aggregators

2024-05-17 Thread Cauvery Krishna
Dear Amar, could you please explain this in simple words? , Ola Cabs has to
submit a compliance report in 90 days from the issuance of this order,
failing which the matter will be reported to the Parliament. I would like
to know why would it be reported to the parliament? Can you explain the
hierarchy of CCPD? For example in usual cases there is trial court then a
high court then the Supreme court.

Dear Friends and Supporters,

As we turn the page on another year, Score Foundation stands tall, celebrating
a remarkable 22 years of empowering and advocating for the people living their
lives with blindness in India. Since 2002, our journey has been one of
unwavering commitment to breaking down barriers and creating a world where
blindness is not a limitation, but a strength waiting to be unleashed.

We began by igniting a spark of information with our radio series on All India
Radio, "Eyeway Yeh Hai Roshni Ka Karawan," guiding and inspiring countless
individuals. We further illuminated the path with the "Nazar Ya Nazariya" TV
series on Doordarshan, showcasing the vibrant lives and achievements of those
who defy visual limitations.

Recognizing the power of connection, we launched the national Eyeway helpdesk,
becoming a trusted source of support and information for the visually
challenged. We further expanded our reach with accessible communication
channels like SMS and WhatsApp broadcasts, ensuring inclusivity at every step.

Today, 22 years later, Score Foundation's flame burns brighter than ever.
Our podcasts continue to empower and educate, while our unwavering advocacy
efforts strive to create a more inclusive India where the talents and
contributions of the visually challenged are not only valued but celebrated.

This Foundation Day, we celebrate not just our achievements, but the incredible
community that fuels our journey. Your support, both past and present, has been
instrumental in enabling us to light the way for countless individuals.

Join us in celebrating 22 years of making a difference!

Throughout the week, we'll be sharing inspiring stories, glimpses into our
ongoing projects, and exciting plans for the future. Stay tuned to our social
media channels for more!

[AI] Assistance in Railways

2024-05-17 Thread Cauvery Krishna
I'd like to know why Indian Railways can't provide assistance for people
with disabilities (PWDs) when airlines and even the Delhi Metro do.
I particularly appreciate the Delhi Metro's assistance process. They have
staff present to help with boarding and deboarding at each station.
However, the long form-filling process is quite time-consuming. It could be
automated by creating a profile on the Delhi Metro app or linking it with
the metro card.
If the Delhi Metro can do it, why can't Indian Railways?
For friends employed by Indian Railways:
what have you done to implement assistance on Railways?

Have there ever been any discussions or any steps taken to implement
assistance for PWDs on Indian Railways?

[AI] What is the situation of diversity hiring by big corporations in India?

2024-05-17 Thread Cauvery Krishna
Friends working in big corporations and HR professionals specializing in
diversity hiring, could you please tell me about the work opportunities
available in these companies?
Specifically, I'd like to know if people with disabilities hired under
diversity programs receive an equal amount of work, respect, and dignity.
Are they simply hired to meet a quota, or is there actual change happening?
Are people with disabilities being treated as tokens?

disability inclusive behavior by cab aggregators

Dear all,

On May 10 2024, the Court of Chief Commissioner for Persons With Disabilities
issued wide ranging directions to Ola Cabs to make their services disability
inclusive. The top points from the order are as under:

 • Allow users to disclose their disability in profile and conduct targeted
disability-specific sensitization for its driver partners
• Appointment of an Accessibility Auditor and a Grievance Redressal Officer
• Clear direction from the company’s CEO to ensure accessibility of all
existing and new features
• Submission of an undertaking by the company to the CCPD for compliance with
accessibility standards and mandating self-certification on an annual basis

Ola Cabs has to submit a compliance report in 90 days from the issuance of this
order, failing which the matter will be reported to the Parliament.

Detailed order is attached for your reference.

Regards,

Amar Jain
