[AI] Negative Response to my Letter
Dear Friends, I am sharing my painful experience in my office. My letter has been treated as indiscipline, misbehavior and got threatening firing from the job. To bring to your knowledge, I am pasting the letter below. To, Chief Justice, Court of Small Causes Bangalore From, Raghavendra Janivar, (SDA), Court of Small Causes Bangalore Date: 18-10-2013 Subject: Providing Assistive Technology Respected Sir, This is to inform you that since July 2012, I have been working as Second Divisional Assistance in the Court of Small Causes. I have waited more than one year for the work solution. However I was sent for four months basic computer training by the department. So far I haven’t been provided any assistive technology to work in the office. I kindly request the honourable court to arrange a computer with screen reading software to give my better service to the department. For your kind information, I would like to draw your attention towards (THE RIGHTS OF PERSONS WITH DISABILITY BILL, 2011) which strongly supports the EQUAL OPPORTUNITY, PROTECTION OF RIGHTS AND FULL PARTICIPATION of the disabled people. The section 56 of the PWD Act strongly recommends non-discrimination in employment and providing all accessibility at the workplace. I hope the Honourable court will fulfill all the requirements very soon and make me work. Thanking You, Yours sincerely Raghavendra Janivar If this is the situation of persons who are working in the judiciary department, what about others? -- With best Regards Raghu Register at the dedicated AccessIndia list for discussing accessibility of mobile phones / Tabs on: http://mail.accessindia.org.in/mailman/listinfo/mobile.accessindia_accessindia.org.in Search for old postings at: http://www.mail-archive.com/accessindia@accessindia.org.in/ To unsubscribe send a message to accessindia-requ...@accessindia.org.in with the subject unsubscribe. In my view, you have not approached to appropriate authority. In stead of writing to Court of small causes, you should have written to the officer who is in charge of providing and ensuring facilities to the employees. This is legal duty of any establishment to provide and equip the establishment with assistive technology to make it congenial for persons with disabilities. I think the registrar of the court is the appropriate authority for this concern. Re: [AI] Negative Response to my Letter
I think it is the ill consequence of giving absolute autonomy and supremacy to the judiciary in India. judges should not be given the power of hearing the cases of contempt of court. it is against the natural justice where one of the party in the litigation itself being the justice giver. in addition, the 'probationary period' is the worst concept that has ever been invented in bureaucracy. hierarchical system in civil service is another major culprit. the legal experts can throw more light on this. coming to the issue, it should be fought unitedly. there are hundreds of second divisional assistants recruited in last year in Karnataka. nearly all of them are facing the same problem. an attempt was made in mysore few months ago to set up an association of visually challenged state government employees of Karnataka to fight for these kind of problems. an ad-hoc committee was setup to look after the establishment and I am also a member of that committee. but due to reasons unknown, no meeting has been convened so far. I tried to remind the concerned persons few times but in vain. very recently, I heard that the process is going on. I can tell even though most the employees are drinking, even during the working hours, if a blind employee did that, they will surely sugar quote that and make it brighter. It is due to jealousy. There are many I can see practically unhappy of our salary if that is little bit higher than their salary. Many sighties are in that category. Let them die with jealousy. All I suggest you is just ignore those idiots and be yourself and safer. Don't get caught doing such things with your employers. Don't trust your surroundings and don't let out your weakness. Mainly don't involve with illegal activities like "drinking"while you're in your workspot. -Original Message- From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf Of Vikas Kapoor Sent: Monday, October 21, 2013 8:42 PM To: AccessIndia: a list for discussing accessibility and issuesconcerning thedisabled. Re: [AI] Negative Response to my Letter
Dear Shankar, I too agree with you that partly some of us are also responsible for these problems in the work place. Many times, we can't create awareness, but many times, the employers don't want to be aware of. Blaming solely the blind community is not actually correct. Some employers / ministries / govt depts have employed VIs just because of law and creating awareness is not an easy job. Finally, I don't know what survey has yielded the result "40 percent of the VIs are taking the advantage of their disability" to you. While giving the figures / informations in percentage, please mention the authentic source; please don't say some percentage and don't take the statistics for granted. Well said missy. Most of them aint utilizing and most of them are just blaming us for that. As we are not doing any job. As per me, I reach my work before ten for the most part. But once in a while, if I go late, just by 15 minutes, I'm getting marked as absent. But in the same department, I'm dam sure many of the sighties are coming to work regularly after 11. But they are marked present. Since we are blind, they pay more care on us in finding fault with us. -Original Message- From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf Of HARSHVARDHAN SINGH NEGI Sent: Tuesday, October 22, 2013 1:45 PM To: AccessIndia: a list for discussing accessibility and issuesconcerning thedisabled.
