Re: [AI] want list of identified post by appropriate government

2012-04-24 Thread Shona Man
Any government may add into the list already prepared by the expert
committee of ministry of social justice, but can not remove it, if any
state government or central government wants any identified job to be
removed from the list then they will have to approach to exper
committee in this regard.
But the real issue that when state don't recognise the list prepared
by the state, and want to implement their own list, say for e.g. U.P
has not still accepted the central list in relation to civil services
through PCS. Neither they apply for exemption as require by the
central expert committee, because they know that their contention will
be outridely rejected.

 Answering your second question Shona:
PWD act has been enacted under article 253 of the constitution with a view
to give effect to international treaties and parliament alone has powers
 to do so.
So, consequently, list of identified jobs issued under section 32 of the
said act has to be binding on state governments.
MSJE has clarified in its OM dated December 29, 2005, that state
governments can add to it and cannot take away from it.
However, in practice it is very difficult to have it implemented, as we
witnessed in Maharashtra where the state government has adopted the said
list after orders from High court, till then they were identifying jobs
arbitrarily and in a patchy manner based on the advice of
 ophthalmologists!!!

 Shona,

This matter has been discussed in the past. Since the post stands
identified there are several candidates even posted as judges across the
nation. The Delhi High Court has reserved posts for blind which in my
knowledge are still lying vacant for want of appropriate candidates or some
relaxation on the part of the Recruitment agency.
