-Caveat Lector- In the Name of "Civil Liberties" by Joseph Sobran The American Civil Liberties Union has been in business so long that itâs a miracle that we have any civil liberties left. Though revered by the media as the "watchdog of the Bill of Rights," the ACLU has always been devoted to the destruction of the Constitution. And still is. Just the other day, the ACLUâs Hawaii branch scrapped plans to invite Justice Clarence Thomas to speak. One ACLU board member compared Thomas to Hitler and called him "an anti-Christ." Such vilification recalls the ACLUâs origins as a fellow-traveling pro-Soviet organization, when ideological enemies were slandered in the roundest terms, "fascist" being a favorite epithet. Itâs telling that Thomas is likened to Hitler rather than Stalin: during the 1930s, the ACLU was full of Stalinists, even on its national board. It reluctantly removed some of them when Stalin made his shocking pact with Hitler in 1939. It later apologized for purging itself of such flagrant apostles of totalitarianism, but it has never explained how men like William Z. Foster, Americaâs leading Communist, could be working for Joe Stalin and the Bill of Rights at the same time. Cynics like Foster were prating about constitutional rights in America, knowing that in Russia, meanwhile, Stalin was torturing and murdering millions who enjoyed no civil liberties or legal protections whatsoever. As Eugene Lyons wrote in his 1941 book The Red Decade: "The presence of Stalinâs henchmen on an American organization of this type was an irony that no amount of sophistry could erase." Itâs only ironic if youâre naive enough to assume that the ACLU has anything to do with liberty. But the Reds and their fellow-travelers specialized in appropriating venerable words for their causes and front groups, which were always "liberal," "progressive," "democratic," and the like. One outfit of American volunteers who fought for Stalin in the Spanish Civil War was called the Abraham Lincoln Brigade. The old words and symbols were used to fool the public, while the leftists were fighting for the very opposite of their professed aims. Today the ACLU is laboring to force the Boy Scouts of America to accept homosexual scoutmasters. What happened to the freedom of association, which the ACLU has always claimed for Communists? Isnât Scouting a "valid alternative lifestyle"? Arenât private organizations allowed to set their own standards and live by their own rules? And shouldnât a group devoted to civil liberties be fighting against state coercion, rather than for it? Communism as we once knew it is gone, but not the sort of people who supported it while it lasted. And they still use the same old semantic tricks, such as using phrases like "civil liberties" and "civil rights" while fighting for abridgments of liberty and individual rights. Though its name appeals to our desire for limited government, the ACLU really stands for enlarged government power. Always has, and always will. It hates Clarence Thomas because he sincerely favors what the ACLU itself only pretends to favor: strictly constitutional government. The hypocrite recognizes the honest man as his deadly enemy. And leftists have always used the coarsest smear tactics against their enemies. Even though Stalin is no longer around to supervise the vilification campaigns, that hasnât changed either. Political libel is an abiding legacy of the Red Decade. Of course the ACLU has no obligation to welcome Thomas, but then the Boy Scouts have no obligation to welcome homosexuals. This is so basic you wonder why thereâs any argument about it. But the Stalinist impulse to subjugate every free institution remains; it neither began nor died with Stalin. We can be grateful that the crudity of the Red Decade is long past, with its brutal one-man tyranny backed by adulating hordes of willing servitors. But today we face a more bland, refined, and subtle version of the desire for an all-powerful state, in which every institution is politicized. Using lawyers rather than firing squads, leftist groups like the ACLU have perfected their techniques. The size and scope of government power are still increasing, under both Republican and Democratic rule. If the Scouts can be forced to take on homosexual scoutmasters, why shouldnât churches and synagogues be told what kind of clergy they may have? New ACLU Advertisement Highlights Massive U.S. Government Electronic Surveillance FOR IMMEDIATE RELEASE Monday, April 9, 2001 NEW YORK--From using a cell phone to sending e-mail over the Internet, Americans' right to information privacy is in peril, the American Civil Liberties Union said today in its latest national advertisement. The ad, appearing in the April 15 issue of The New Yorker and the April 16 issue of The New York Times Magazine, features a large photo of a cell phone, with the headline: "Now equipped with 3-way calling. You, whoever you're dialing, and the government." The statement, the ACLU said, is no exaggeration. Through surveillance programs with ominous names like "Echelon" and "Carnivore," government agencies are violating the Fourth Amendment, which was adopted for the express purpose of protecting Americans from unwarranted government surveillance. "The same technological advances that have brought enormous benefits to humankind also make us more vulnerable than ever before to unwarranted government snooping," said Barry Steinhardt, Associate Director of the American Civil Liberties Union. "Through this advertisement, the ACLU hopes to increase awareness of the privacy threat and mobilize our lawmakers into action." The advertisement urges readers to visit a special ACLU website http://www.aclu.org/privacyrights to learn more about these invasions of privacy rights and to send a free fax message urging their Members of Congress to stop the use of Carnivore and to hold hearings on the secretive Echelon program. According to the ACLU ad, five nations (the U.S., England, Canada, Australia and New Zealand) are members of a spy network -- dubbed Echelon -- that aims to intercept virtually all forms of electronic communications. Its purpose: worldwide surveillance, not just of other intelligence agencies, but of civilians. Meanwhile, through the FBI's Internet wiretap system, dubbed "Carnivore," U.S. Internet service providers are forced to attached a black box directly to their networks -- a powerful computer through which much of their customers' communications may flow. "Congress must cage Carnivore and determine if the Echelon program is as sweeping and intrusive as has been reported," said Gregory T. Nojeim, Associate Director of the ACLU's Washington National Office. "Congress must ensure that our government does not intercept Americans' conversations without a court order. That is why the ACLU has called upon Congress to embark on a national legislative program to shore up the information privacy rights of this and future generations." The creative minds behind the ad series, DeVito/Verdi Advertising, also developed last year's ACLU advertising series, which included messages on racial profiling, juvenile justice and the death penalty. But the American Civil Liberties Union said it would fight to keep vote-auction.com on the Internet, saying the Web site was constitutionally protected under the First Amendment. "We think political parody and satire is protected whether on the written page or the Internet," ACLU legal director Harvey Grossman said. The Chicago Board of Election Commissioners, which sued to shut down the site, said it was assured by the site's Swiss registrar, CORE Internet Council of Registrar, that vote-auction.com would be taken off the Web. The Swiss group sent the board email saying it was acting "since it does effectively appear that this domain name is used in connection with unlawful activity." The message referred to an order that Cook County Circuit Judge Michael Murphy issued at the request of Chicago election officials, requiring a similar-sounding site, voteauction.com, or any site like it, to be deleted from the web. Several attempts to open either site failed Wednesday, though vote-auction.com had been in operation a day earlier. The site was created by James Baumgartner, a student at Rensselaer Polytechnic Institute in Troy, N.Y., who said he did it as a parody to "evoke public commentary concerning an issue which is at the core of this nation's democracy, whether or not elections are for sale." "I want to emphasize that at no time was it my intent to have people buy and sell votes," he said in an affidavit the ACLU's Grossman showed reporters. But Chicago Board of Election Commissioners spokesman Tom Leach said the site only encouraged people to break the law. At the request of election officials, Murphy ordered a Pennsylvania-based registrar, Domain Bank Inc., to take voteauction.com off the web. Baumgartner sold the domain rights to Hans Bernhard of Vienna, Austria, for one Euro, less than a dollar. And Bernhard then arranged for the Swiss group to establish the domain vote-auction.com. Bernhard had claimed, without proof, to have been offered $260,000 for more than 21,000 votes. Even if that could be verified, there is no way to prove how the 21,000 votes would have been cast. Votes were being offered in blocks by state. For instance, the highest bidder for Michigan, a battleground state with 18 electoral votes, could direct 1,429 votes to any candidate. The current top bid for those votes was $28,000, the Bernhard site recently claimed. The ACLU began its fight to keep the site alive by getting the case transferred out of Cook County Circuit Court and into federal court. It now goes before U.S. District Judge William J. Multiculti in face and sound, the march brought more than 10,000 people into the sun-drenched streets of Los Angeles. The blocks filled with members of MECHA (Mexican Chicano Student Association) calling out "el pueblo unido jamás será vencido" (the people united will never be defeated) and Tibetans sounding gongs. The Billionaires for Bush or Gore rolled beneath the sheets, performing Bush-and-Gore-in-bed scenes. Walking and dancing and generally California good-vibing from Pershing Square to the Staples Center, protesters cavorted and chanted through largely Central American downtown L.A. Sweatshop workers appeared in windows, or behind gates, some showing support, some lobbing the occasional sewing spool. From other windows and terraces, families waved and cheered. Firetrucks sprayed water to cool the overheated dancers. Much festivity followed the Peace and Justice float, from which riders alternately called out messages in Spanish and blared Rage Against the Machine's Battle for Los Angeles, a psych-up for those anticipating the band's free concert outside Staples. At Staples, the good vibe went awry when Black Bloc anarchists confronted police through the fence separating the protesters from the convention center. On a giant video screen, Hillary Clinton thanked the delegates for their warm welcome, while outside two anarchists scaled the fence and sat atop it. Other demonstrators raised fingers to the helicopters buzzing above. Some 30 minutes after the protesters were ordered to disperse, one hour before the permit was to end, police in military formation rushed in on horses, firing rubber bullets and pepper spray on peaceful protesters still trying to exit. The National Homeless coalition, which had a permit to march on a nearby sidewalk, was caught unawares in the midst of riot police, and reported one of its organizers hit by rubber bullets as well. The police response was condemned by the ACLU, in a press release issued after the protests. "Had the police cooperated with the rally organizers, the night could have ended calmly and smoothly," the ACLU wrote. "Instead the police response tonight created huge risks. -Caveat Lector- New Jersey High Court Says Ban on Gays in Boy Scouts Must Go FOR IMMEDIATE RELEASE Wednesday, August 4, 1999 TRENTON, NJ -- In a unanimous decision, the New Jersey Supreme Court today said that the Boy Scouts of America's practice of excluding or dismissing a member solely on the basis of sexual orientation is illegal under the state's anti-discrimination law. The Court also rejected the Scouts' claim that the First Amendment gives them the right to discriminate. The American Civil Liberties Union, which filed a friend-of-the-court brief in the case, hailed the decision as a tremendous victory for lesbian and gay rights. The ruling upholds a March 1998 state appeals court decision that prohibited the Boy Scouts from banning gay members. "This decision debunks the notion that just because someone is gay means he or she is unfit to serve in the Boy Scouts or any other civic group for that matter," said Lenora Lapidus, Legal Director of the ACLU of New Jersey. "The Court did the right thing in denying the Scouts' claim that the First Amendment gives them the right to discriminate. People have the right to believe what they want, but that is no more a justification for discrimination now than it was in the South 40 years ago." The case arose in 1990 after James Dale, a Matawan assistant Scoutmaster, was ousted from the Boy Scouts when leaders discovered he was gay. Prior to his expulsion, Dale, an Eagle Scout, had risen successfully through the ranks and earned 30 merit badges and other awards during his 12 years in the organization. "Goverments and local charities have been increasingly unwilling to fund and sponsor Scout programs because the Scouts insist on discriminating," said Matthew Coles, Director of the ACLU's National Lesbian and Gay Rights Project. "This decision is bound to accellerate the trend against anti-gay policies." The court ruled that because the Boy Scouts of America are "places of public accommodation" that "emphasize open membership," they must adhere to New Jersey's anti-discrimination law and cannot deny any person "accommodations, advantages, facilities and privileges" because of sexual orientation. While the Boy Scouts vowed to appeal today's ruling to the U.S. Supreme Court, the ACLU's Coles expressed doubt that they would hear the case. "The Court rejected a very similar argument that the United States Jaycees, a business association, made to justify excluding women," Coles said. "That was 15 years ago, and the Court ruled unanimously. I doubt they would revisit the issue now." Today is not the first time the ACLU has taken legal action to halt unfair practices of the Boy Scouts. In May 1998, the ACLU blocked an Oregon school district from actively recruiting Cub Scouts since they are required by the Boy Scouts of America to refuse membership to boys who do not "profess a belief in God, recognize an obligation to God and declare a duty to God." For similar reasons, this past April, the ACLU sued to end government sponsorship of Boy Scout programs in Illinois because they violated the constitutional requirement of separation of church and state. The $7 million from the Foundation, together with other significant commitments, has enabled the ACLU to surpass its initial goal of raising $25 million for its first ever endowment six months ahead of schedule. The Foundation said that the contribution is the second largest endowment gift it has given in the past decade and among the largest ever in its history of giving. "The Ford Foundation has long supported the ACLU's essential role in protecting individual rights and fighting discrimination," said Susan Berresford, the Foundation's President. "This gift will help ensure that future generations will continue to benefit from the ACLU's important work." As a litigant in virtually every important Supreme Court case involving civil liberties, the ACLU has been central to the development of democratic ideals in America. But the fight, according to Ira Glasser, Executive Director of the national ACLU, is far from over. "The ACLU has had no better partner and friend than the Ford Foundation," Glasser said. "The Trust for the Bill of Rights was created to allow us to continue our defense of the Bill of Rights, eradicate invidious discrimination and protect individual civil liberties into the next century. It is fitting that the largest single gift to this effort, and in fact the largest gift ever to the ACLU, should come from Ford." The gift will continue to support the ACLU's work on behalf of reproductive rights, voting rights and against discrimination based on race, gender, national origin or immigration status. Glasser noted that the endowment gift would not preclude the ACLU from applying for other grants from the Foundation in the future. If you answer all of the questions, you can determine if the person has heart problems, diabetes, etc., just from the medication they take. You know the books they like to read, and the music preferred. YOu know if they like sports or gardening, or whether they have a scientific mind. You know what kind of aspirin they use, nd how often which is indicative of one with migraines, just hooked on aspirin, or with a serious disorder - and I love in particular, the questions are what an insurance company would ask prior to giving you a policy. And lo and behold -you are suddenly deluged with mail from insurance companies (one or two in particular), and the entire of your interests, is in your mailbox each day.and someone somewhere, knows just who and what you are. Years ago, in the early 70 period, I was sent a 20 page questionairre being conducted at a University with similar quesions, about clothes I liked - and I spent considerable time answering each question.at the very end, they asked "What do you do for a liviing'and I put "I am a Hooker..", sealed it, and mailed it. Who in their right mind would fill out a report such as that, without question. Today, you tell it all to Jerry Springer, make a grade-A full of yourself, and get paid accordingly. I would say that they definitely do display hypocrisy about some issues, but it does not negate the tremendous good that they do lobbying congress for protection of civil liberties, preserving privacy rights, and preserving property rights *** The aclu are nothing but a bunch of lawyers so it has a turd base. I would venture to say that the case like you cite are specifically promoted by their detractors in order to establish the (false) premise that they are JUST in the business of suing people who pray or mention God in school (which I'm not against since the Constitution does not prohibit such). So, in closing, the ACLU are not "my buddies", and yes, I do believe they have an agenda, and no, I don't support everything they do, BUT they are doing some good things and I wanted to give people a resource for research as well as a tool to effect change in areas that they are concerned about.
