Hmmm, I have a feeling I'm opening a whole new can of worms by returning
to this old discussion, but I bought this really cool-looking stone
figurine of an otter recently.  I've found a site that sells them on the
internet, just so people have an idea of what it looks like:

the one called Oprah; it looks much cuter in person :-D).

Now the question I have is simple: I know the otter itself is copyrighted
artwork, but what about the photographs?  Does the copyright belong to the
artist, or to whomever took the photograph?  In other words, if I snapped
a picture of that otter, could we use it?

Hi,

Reading a certain recent whiny post about not getting help, it occurred to 
me what the Cygwin mascot's name must be:

	The Cygwin Meany


The only problem I can see is that no one thinks of otter's as mean, so 
perhaps one of it's relatives. According to the phylogenetic structure sent 
by Charles Wilson, otters are weasels, so perhaps that would work.

But given the opportunity at hand, I must again suggest the badger, my alma 
mater's mascot. According to Chuck's phylogeny, it's a close relative of 
the otter. And much more likely to win when taking on a big monster...

Hey, someone caught on to my thinking... ;-)  Not that I have anything
against otters.

If you want more animals that never made it onto an O'Reilly book, how
about a chinchilla?  Warm and furry, like the otter.  Some intersection
here with the Chinchilla project, though...

How about the platypus? I know that Slackware
used to use it before, but I don't know if it was trademarked? I
remember buying a Walnut 
Creek slack distro back in '97 that featured the
platypus logo. Looked pretty cool, too. Platypi 
are utterly unique, and I don't recall ever seeing an O'Reilly book
with one on the cover!

I could give more reasons to choose a cygnet, but
why waste the time?

If cgf wants an otter, we should be looking into
how to get a good drawing of one. Preferably a
mean one, I guess. :-) I suppose we can give it
sunglasses at least. Or have it smashing through
a window carrying twin machine-guns. :-) :-)

So what type of drawing are we looking for? And
how small does it need to scale? For an icon you
probably aren't going to get more than the head
(especially if it's the larger sea otter).

Yeah, that's a good idea.  Let's infringe on a Disney copyright.  They 
don't usually mind that sort of thing, do they?

Geez, what's wrong with otters?  It doesn't matter if O'Reilly has used 
various otters on a collection of [Java|HTML|???] books -- as long as 
we're not copying THEIR otter design.  (Because they've used it on books 
covering a range of subjects, there's no brand identity like camel == 
Perl)  Besides, give O'Reilly another few years, and they will run out 
of mammals and start using insects...or plants.  The only company that 
uses an animal mascot, and that believes that ONLY they are allowed to 
use ANY representation of that species as a mascot regardless of 
similarity to their own version, is...oh yeah, Disney...

What was that about 'stitch'?

Otters are cute and playful, and surely cgf deserves a say in this given 
his steerage of the project.  Should he start talking about sprinking 
holy otter pee on the codebase prior to each kernel release, like Linus 
does, just to push otters into the zeitgeist?  (mebbe not. otter pee 
doesn't have quite the same alliterative punch as penguin pee)

'Course, it's all moot until somebody with artistic talent (e.g. not me) 
actually draws something...

P.S. anybody remember the oil-slicked otter that Berke Breathed drew in 
Bloom County?  He was a spokesman for Exxon after the Valdez 
incident in the 80's...shunned as a sell-out by the other members of the 
cast...

Sorry, sorry, I was just kidding. I always found the girl in the movie
had a funny of saying I think it's a koala. Seeing the word here just
reminded me of it.
Maybe I should have use a ;) instead of :).

Otherwise, I have nothing against the otters. Actually I find the koala
a little too lazy to be a good mascoot (but Stitch isn't by the way...
no, please, don't hit me me, I was kidding again).

If anyone wants my opinion, I would select an animal that has a meaning
to cygwin more than its cuteness, like Gerald's cygnet, or the
enigneer's mascott the beaver. Otters are fine there too since they do
use tools (for those who don't know, they use rocke as a hammer with
their belly as an anvil and shells in between)

 This guy's furry persona (not sure of the terminology of this 
 subculture) is an otter, so most of his art is otter-ish.

The furry subculture has been around for many years.  I remember seeing
people dressed in various half-man half-other at TimeCon(tm) back in the
mid 70s.  Furry can best described as a mutation between human and
anything else.  I recall it first started with animals which had fur
(tigers, lions, cats, etc), hence the name furry, but later branched
out to other types of animals (sometime even alien).  Many people choose
an animal that they best identify with and create a persona based on that
animal.  There are even conventions devoted to Furry Folk (ConFURance is
a popular one). 

Anyway, since he is an artist (and his work seems pretty good) and he
does otters, it might be worth a few bucks to have him create something
for Cygwin.

I made the window.  Since the MS logo has curvy
windows with trailing pixels, I wouldn't think that
there would be any trademark infringement because
there is no chance that one could confuse the two.

That is true, but Cygwin does make it easier to compile Linux programs
under windows.  (maybe replace Linux with POSIX, but the most
popular POSIX OS in Linux) [maybe replace popular with well known]

thingie is? will see the logo and get the impression that it just
some kind of linux to be run on windows.

Oh - this is an actual thing that needs doing? I was only messing around
with stuff.
Well I'll finish what I'm doing. If anyone's interested in it I can rework

If it makes any difference, the otter is used on the cover of several
O'Reilly books (Java Net Prog, Perl for Sys Admin, Web Design in a
Nutshell).  Not that I have anything against Otters, mind you.  The
picture in Web Design in a Nutshell looks pretty neat.  With a little
fiddling to make it more simplistic/stylized, it'd render as a small
image fairly well.  Or perhaps the profile of Perl for Sys Admin would be
better?

Figured those FurryMuck people might be able to help -- they like to

subculture) is an otter, so most of his art is otter-ish.

(FYI lutra or lutrinae is the name of the otter subfamily) --- which
