The American people have just been hit upside the head with a plank: $7 trillion of what people thought they were worth disappeared in a giant "earnings restatement." And now it is time to gently suggest what can be done to fix this. Or maybe not so gently, since failure to fix it is likely to cost so much that $7 trillion will look like chump change. Our political system is so broke it took seven years to react to the savings and loan crisis, which was caused by the political system in the first place. That cost us only $500 billion. If they take seven years to stop this hemorrhage, we'll be totally sunk. Step Numero Uno: public campaign financing. This mess is not just about corporate greed; it is just as much about political corruption. Perhaps the least edifying sight so far is that of politicians pointing their fingers at the CEOnistas and clucking over their greed. First and funniest was President Junior, whose entire business career was this very same corporate scandal writ small. The man is the mascot of crony capitalism. Listening to his lecture to Wall Street about their need for moral rearmament and better business ethics was first-rate entertainment. Years of covering politics have given me a cast-iron stomach, but the sight of Representative Billy Tauzin, Republican of Louisiana, posing as a born-again populist is enough to gag a maggot. This is the same Billy Tauzin who led the charge on every sell-out to corporate special interests of the last ten years. Then there's Mr. Morality, the oh-so-pious Senator Joe Lieberman, well watered by campaign contributions from the Big Five accounting firms to make sure they weren't regulated. Whew, what a stench! The pols need to turn those pointing fingers right at themselves. Starting in 1994, when the Financial Accounting Standards Board was preparing to rule that stock options must be treated as a company expense--a step that would have reduced corporate earnings and thus deflated stock value--the high-tech and securities industries vehemently opposed the move. Lieberman leaned on the board to back down, and it did. Lieberman is number thirteen in the Senate for contributions from the securities and investment industry. That move set up the explosion in executive compensation and gave CEOs a huge incentive to artificially inflate their stock prices. The next step was in 1995, when Congress passed the Private Securities Litigation Reform Act, which makes it harder for shareholders to sue corporations. This act also allowed executives to make absurd claims about future earnings by scrapping the old prohibition against forward-looking statements. There are basically only two ways to control capitalism: One is by government regulation, and the other is through the courts. Wave after wave of "tort reform" made corporations increasingly sue-proof. The much maligned trial lawyers and their so-called frivolous lawsuits actually functioned like the sharks they are so often compared to. If a corporation stuck a hand outside the law, a shark would swim by and bite it off, as it were, by suing for lots of money, a lovely incentive for decorous corporate behavior. But the politicians have been killing off the sharks. Bill Clinton vetoed the '95 Litigation Reform Act, but it was passed over his veto with help from Senator Chris Dodd of Connecticut, among other Democrats. The third horror was the successful efforts in both 1999 and 2000 to prevent the SEC under Arthur Leavitt from forcing accounting firms to separate their auditing and consulting functions. Pre crime in the warthland.
John Ashcroft recently released his guidelines for investigating people he
suspects as terrorists, and these guidelines exceed even J. Edgar Hoover's
contempt for due process.
Activists particularly--and I expect the term applies to a good many
readers of The Progressive--should know what may well be in store for them.
On page three of "The Attorney General's Guidelines on General Crimes,
Racketeering Enterprise and Terrorism Enterprise Investigations," we are
told: "A terrorism enterprise investigation may be initiated when facts or
circumstances reasonably indicate that two or more persons are engaged in
an enterprise for the purpose of . . . furthering political or social goals
wholly or in part through activities that involve force or violence and a
federal crime . . ."
Note the use of "reasonably" and "wholly or in part." These insidiously
malleable guidelines for terrorism investigations could apply to political
action (and the reaction) during demonstrations by environmentalists,
anti-globalizationists, animal rights pickets, or union members on strike,
as well as pro-lifers trying to talk, and only to talk, to women entering
abortion clinics ("obstruction" at clinics can be a federal crime).
The guidelines go on to note that "the 'reasonable indication' standard for
commencing a terrorism enterprise investigation is . . . substantially
lower than probable cause." It is so low it could be part of the new Steven
Spielberg-Tom Cruise movie, Minority Report, which envisions the nabbing of
"pre-criminals." As The Washington Times puts it, such pre-criminals are
convicted "before they ever act on, or, in some cases, are even aware of,
their murderous designs."
On page four of the Ashcroft Guidelines: "The nature of the conduct engaged
in by a [terrorist] enterprise will justify an inference that the standard
[for opening a criminal intelligence investigation] is satisfied, even if
there are no known statements by participants that advocate or indicate
planning for violence or other prohibited acts." (Emphasis added.)
The Attorney General, furthermore, extends the dragnet to make individuals
in a group under suspicion responsible for what other members say or write:
"A group's activities and the statements of its members may properly be
considered in conjunction with each other. A combination of statements and
activities may justify a determination that the threshold standard for a
terrorism investigation is satisfied, even if the statements alone or the
activities alone would not warrant such a determination." (Emphasis added.)
Also indicating the "pre-crime" mindset of Attorney General Ashcroft is the
following paragraph. "While no particular factor or combination of factors
is required, considerations that will generally be relevant whether the
threshold standard for a terrorism investigation is satisfied includes as
noted, a group's statements, its activities, and the nature of potential
federal law violations suggested by its statements or its activities."

Keep in mind the massive, pervasive electronic surveillance--with minimal
judicial supervision under the USA Patriot Act--of inferential "pre-crime"
conversations and messages, both sent and received. Add to that the FBI's
power, under the same law, to break into your home or office, with a
warrant, while you're not there, and inset "The Magic Lantern" into your
computer to record every one of your keystrokes, including those not sent.
Then add the Patriot Act's allowing the FBI to command bookstores and
libraries to reveal the books bought or read by potential domestic terrorists.
You may now appreciate the prophecy of Senator Frank Church--who was
instrumental in exposing the constitutional crimes of J. Edgar Hoover's
Cointelpro operation--when he said in 1975 that future government
intelligence capabilities could "at any time be turned around on the
American people, and no American would have any privacy left--such is the
capacity to monitor everything, telephone conversations, telegrams, it
doesn't matter." And that was before the omnivorous, permeable Internet.
The Web can be a spider web.
Senator Church, referring to "potential" enemies of the state, warned:
"There would be no way to fight back because the most careful effort to
combine together resistance to the government, no matter how privately it
was done, is within the reach of the government to know."

Hierarchy versus Network.
Ray ozzies blog...Tyranny, Terror, and Technology Unreasonable taxation. Unwarranted violence. Tyranny. King George had managed to bend the laws of the time to suit the government's needs, enabled by extreme "centralization" of power. In creating a new nation, our founding fathers sought to develop a new type of governing body: one that fostered and assured liberty "at the edge", recognizing individualism, equality, and the natural rights of mankind. But doing so was tough. The concept of "democracy" taken to its extreme could arguably have resulted in the tyranny of the masses. What was needed was a new organizational form: one with checks and balances. An appropriate mix of centralization and decentralization, masterfully formed so that it could take on the best attributes of both. A wholly centralized executive branch for strategic leadership and vision, a wholly decentralized legislative branch which best represented the needs of those living at the edge, and a judicial branch to ensure balance between the two ... and justice for all. The founding fathers had mastered the art of shaping organizational networks. In creating the U.S. government, they'd "mastered the network form", empirically creating an organization with sustainability, resiliency, and agility. Fast forward. In the course of my work with our many customers in DC, earlier this year I had the honor of meeting John Arquilla - coincidentally only about a month after reading a book that he had edited with David Ronfeldt - Networks and Netwars: The Future of Terror, Crime, and Militancy. In listening to him speak eloquently and with conviction, and in reading his book, I found an incredible and unexpected parallel between our defense challenges and those that I'd been dealing with for years in commercial environments. Many of my enterprise customers' issues - those that led me to create Groove - seemed directly analogous to those confronting world governments in combating terrorists' organizational forms: The need to coordinate and organize for effective strategy, tactics, logistics, execution. The need to find the appropriate mix of organizational centralization and decentralization. The struggle to get off-the-shelf technology to work across organizational/security boundaries. The need to address leadership and doctrinal issues that arise when effective cross-boundary collaboration becomes mission-critical. Could the solutions also be analogous? (I strongly recommend the book if you haven't yet read it - full text online since late last year. "It takes networks to fight networks; whoever masters the network form first and best will gain major advantages." In it, you'll find example after example of edge-based, largely decentralized organizational forms and how they compete, e.g. how swarming tactics can be used to overwhelm adversaries. In reading it, I gained a much better appreciation of the challenge before us in combating highly-decentralized organizations - from al-Qaeda to drug-smuggling cartels. The premise that hierarchies have a difficult time fighting networks is compelling.) I must say that my initial reaction was something akin to "this threat model is going to be close to impossible to deal with." But over the next week or so, it began to dawn on me that there might be lessons to be learned from the challenges that our major corporations have faced over the years when confronted with swarms of smaller, more nimble competitors, or companies that have a better mastery of the network form. Take Wal-Mart. Cross-docking has been reportedly nothing short of a transformational strategic logistics methodology for Wal-Mart - a distribution network form that has proven extremely difficult to compete with. Clearly the "winner" is not likely to be the massive wholly-centralized bureaucracy, nor the wholly-decentralized organization (which can have severe coordination issues when coordination is truly necessary), but the organization that can find the best and most effective integration of centralized and decentralized operations. And although business collaboration and business modularity tends to be mostly about transaction cost economics, in defense it's about refining the network form for superiority in intelligence, analysis, decision, and action. Broadly decentralized intelligence, semi-decentralized analysis, and centralized decision-making. And action that leverages the best of centralization (massive use of force) combined with the best of decentralization (on-the-ground dynamically tasked special forces). Furthermore, the same technologies used to support cross-enterprise collaboration can also be leveraged to span formerly-stovepiped organizations in government - bridging secure networks, or even working across unsecure networks. Joint forces, coalition forces, intelligence, national and local law enforcement, the national guard and coast guard, INS, and even NGO's.

The forerunner of the Law Enforcement Data Exchange (LEDX) was a system known as DocuShare, developed and marketed by Stamford, Conn.-based Xerox Corp. The product started out as a way for five company research centers to collaborate and share information, said Colman Murphy, Xerox's DocuShare product manager. "So they designed it to be secure but also to make it very easy for distributed work groups to build collaborative spaces and to share information," he said. "So it has a lot of security capabilities built into it, like the user name and password control on not just areas of the DocuShare server...but actually right down to each individual document. "The users themselves get to control that access. I, as the user, can decide who else can view this document down to the individual level. Also, the site itself can be administered among the users. So it distributes the administration mode across the organization. You don't have to have a large [information technology] organization to set it up, to administer it, to manage the content, to give people permission. All of that can be distributed across the organization." Murphy said the product could store any document in its original format. The application also includes filters to convert more than 200 file formats to HTML quickly and easily. Larry Hunt, chief engineer and chief executive officer of Integrated Digital Systems/ScanAmerica Inc., tried to come up with a better way to exchange information among the Internet Crimes Against Children task force centers. Because his company was one of Xerox's top value-added resellers and because he was familiar with DocuShare, Hunt modified the product and called it LEDX. An "anonymous remailer" is a computer that receives an electronic message over a communication link from a sender and redirects that electronic message to an intended recipient. By encrypting audible and/or viewable data of the electronic message, the integrity and confidentiality of that data would be protected against unauthorized access by the operator of the anonymous remailer or an interloper. It is evident that the above-described conventional communication scheme would substantially ensure the preservation of the integrity and confidentiality of data within an electronic message. However, this conventional communication scheme fails to protect the integrity or confidentiality of data transmitted back to the original sender in the form of a response from the intended recipient. In certain situations, anonymous remailers have been configured to assign a unique tag to each original sender of an electronic message before the electronic message is redirected to the intended recipient. This tag is used as a secret key by the intended recipient to encrypt data contained in a response to the electronic message. However, to support this communication scheme, the anonymous remailer would have to decrypt the response with the tag and re-encrypt the response with the public key of the original sender because the intended recipient would have no knowledge of the original sender, namely a public key of the original sender. Since the operator responsible for the anonymous remailer would have access to the return path of the response, reliance on the integrity of that operator is required. Clearly, this substantially reduces the level of *security* of this communication scheme. Noelle Bush was arrested in January at a Tallahassee pharmacy drive-through window for allegedly trying to buy the anti-anxiety drug Xanax with a fraudulent prescription. She was admitted to the treatment center a month later, with the possibility charges would be dropped if she completed the program. Colombia: Trade Unionist murdered over Coca-Cola law suit. On 31st August union activist Adolfo de Jesus Munera was murdered, shortly after receiving notice that a law suit filed by him against Coca-Cola had been accepted by Colombia's Constitutional Court. Adolfo de Jesus Munera, leader of the Sinaltrainal food industry workers' union, and former employee of the Coca-Cola plant in Barranquilla, was shot dead by unknown gunmen on the doorstep of his mother's house. In April 1997 Coca-Cola's plant chief had requested the Colombian authorities to take action against Munera, accusing him of being a rebel sympathizer. After a raid on his home he went into hiding, and was dismissed for not showing up at his workplace. Munera filed a law suit, demanding to be reinstated in his job. Munera won in the first instance, but at a higher level the company's arguments were accepted by the judge. Munera appealed and on August 22nd he received a letter saying that his case had been accepted. Seven union leaders from Coca-Cola plants in Colombia have already been murdered and others abducted and tortured. Almost 4000 national federation CUT union activists have been assassinated since 1986, without the Colombian authorities taking serious steps to prosecute the killers.
