Though you'd still need the passphrase/dongle. you couldn't *mount* a disk in hardware; you *could* decrypt on-the-fly and make the physical disk look like a unencrypted one, but you would still need non-crypto software to mount it. for virtual drives, the real question is at what point in the boot process you can mount a drive - if it is not until the os is fully functional, then you are unable to protect the os itself. if the bootstrap process can mount the drive before the os is functional, then you *can* protect the os. No you can't. If the drive is mounted before the OS is loaded you can put the system into a DMA state and read the disk (screw the OS) since it's contents are now in plaintext. no, you can't. data from the hardware is *still* encrypted; only the output of the driver is decrypted, and a machine no longer running bootstrap or os is also incapable of decryption. you *could*, if good enough, place the processor in a halt state and use DMA to modify the code to reveal the plaintext, but it would be a major pain to do so and would require both physical access to the machine *while powered up and without triggering any anti-tamper switches* after the password has been supplied. This is actually a weakness in firmware cryptodrives (as I have seen advertised recently) - once the drive is unlocked it can usually be swapped over to another machine and the plaintext read. You can also prevent the default OS from being loaded as well. Indeed so, yes. however, usually that decision has to be made before the password would be entered - so making more awkward. you *could* finangle the bootstrap though; there must *always* be part of the code outside the crypto envelope (but of course this can be removable media such as the usb drive mentioned, and stored securely when not in use) Clue: If you own the hardware, you own the software. indeed so. however, if that applied to machines not already running, the police wouldn't be so upset when they find encrypted files on seized hardware.

'We're Solid': Union Renewal on the Pilbara Bradon Ellem* charts the history of the Pilbara dispute, and finds a revitalised grass-roots unionism challenging BHP's individual contracts bulldozer On Monday 2 July, the Western Australian Industrial Relations Commission began to hear a union claim for a new award for iron ore workers employed at BHP's Pilbara operations. This, of course, is no ordinary hearing. The company found itself in a place it had been determined to avoid, confronting a collective it had tried to crush over the previous twenty months. In 1999, BHP Iron Ore set out to break the unions on the Pilbara. On 11 November, BHP offered the members of its Pilbara iron ore workforce a considerable wage increase and massive cash pay-outs on accrued entitlements if they would walk away from collective bargaining and sign individual contracts, Western Australian Workplace Agreements, officially know as WPAs but colloquially referred to, along with those who signed them, as 'woppas' (or perhaps 'whoppers'). Later, company executives would be quite clear about their motivation, one telling the Federal Court that the key aim was 'the removal of the needs to negotiate change with union representatives'. The existing enterprise agreement was undesirable precisely because it required such negotiation. Management confidence The management of the company was entitled to be confident about the likely uptake of these contracts. After all, the rest of the Pilbara had long been deunionised following the high profile successes of employers at Robe River in the 1980s and Hammersley Iron in the early 1990s. And the Pilbara itself is isolated and, many would say, utterly different from the rest of the country. The BHP sites were spatially diverse: from the mine at Newman to the treatment plant and shipping facilities at the coast 450 kilometres away at Port Hedland. As if these sorts of physical problems were not enough, the unions themselves were divided, engaged in increasingly bitter disputes with each other over coverage. The company's management played its cards pretty well. Wage negotiations had been stalled for some time and it was clear that management was trying to edge out of collective negotiations. The company was reducing employment levels, introducing workplace change, cutting back on union access and stringing out the enterprise agreement talks. There were visits from American management gurus and 'hug and tug' sessions to introduce the 'new BHP' to the workforce. Then came the contract offers, smartly packaged, posted to the workers' homes just six weeks out from Christmas. At first sight they seemed attractive, with huge pay-outs of sick leave and an apparent wage increase of up to $20 000. These agreements would run for five years and, of course, contained no provisions for union representation or defence. As with other companies trying to de-unionise the workforce, BHP's devil is in the detail. Union members argued that once bonuses and overtime rates disappeared, the apparent wage increases would evaporate. Most importantly, terms and conditions - and changes in them - would be governed by the Staff Handbook, not the agreement itself. One train driver, John Radford, said that you didn't need to be Einstein to work out what the WPAs meant: work as directed, work when, where and how - and hope the company looks after you. Of course, the WPA did not explicitly forbid unionism - that would be quite illegal - but it excluded the union from any of the formal procedures and in fact, just about excluded the employee from any say either! Over the Christmas holidays, as many workers went away, the company's offer began to bite. Workers started to drift away from the unions while new starts were confronted with a stark choice: 'sign the WPA or look somewhere else for a job'. Tensions between friends rose, community associations became divided, families too began to split. The children of union loyalists signed on to the contracts, desperate for a job. Like all long-running disputes, there were immense personal as well as public costs; workers for whom unionism was an article of faith wondered what they had done to 'let down' the next generation. When 45 per cent of the workforce signed contracts over the summer of 1999-2000, the union cause looked doomed. Yet, after that there was little movement away from what those remaining were now calling 'the collective'. In April 2001 when the company made a further round of offers, with still more enticements to quit the union, there was almost no uptake. Quizzed by ACTU officers in Melbourne, Ross Kumeroa, one of the mining union convenors, assured them there would be no further losses: 'We're solid'. By the middle of this year, the trend seemed to have been turned right around - so much so that non-union workers from the other Pilbara mine sites were holding meetings to begin their own union revival.

actually..noit isn't my bust. it is yours. it says: knowingly and willfully uses encryption technology to conceal any incriminating communication relating to a federal crime that they're committing, or attempting to commit. Thus, after the fact.I can send you an ecrypted email detailing my crime and I won't be upping the ante another five years. Sure you will. The ongoing conspiracy (an agreement to commit a felony) continues after various events. For example, if Ted and Alice have an ongoing implicit understanding that they will meet in the shed behind her house occasionally to tend the five marijuana plants growing there, that is an ongoing conspiracy to commit a federal felony. So if, a week after Ted's last visit, Alice sends him an encrypted email saying Come over and watch a video, or whatever, the prosecutor can clearly use that (if he can decrypt it) as 5 more years in prison, since it used encryption technology and concealed an incriminating communication (the crime being conspiracy) that they are commiting (ongoing). The prosecutors can get Ted's passphrase by granting him immunity (probably ONLY immunity from the encryption enhancement penalty, or best case, from that and conspiracy, still nailing him for the pot felony, or getting Alice to roll over on him for the whole deal) and forcing him to disclose it having eliminated his 5th amendment defenses. Then they have Alice for the pot felony, conspiracy, and the 5 year encryption booster. Of course, they will simply hang all of this draconian punishment over her head, her attorney will say they can fight for $75,000 and 2 years, during which she is in jail, or they can plead it out and become a felon with few further rights of citizenship. And if you detail a crime after the event in an encrypted communication, you've essentially included another person in the knowledge of a past crime in the expectation that such disclosure will remain secret from law enforcement. That is conspiracy to avoid prosecution and probably obstruction of justice. Conspiracy and obstruction are crimes, you've just used encryption in a federal felony, 5 year enhancement. Bye. Merdeka Selatan, Central Jakarta. Police with riot shields were on hand near the U.S. Embassy, but the crowd was peaceful. The protesters dispersed shortly after midday. On the same issue, hundreds of PKB supporters protested at the Hotel Indonesia traffic circle in Central Jakarta. The protest caused only a slight hitch in the light Sunday traffic in the capital. There are no reasons that can justify a war, PKB Jakarta chief Marzuki Usman, a former minister, told the protesters. PKB claims to be an inclusive political party, but its base comprise traditional Muslims from Nahdlatul Ulama, the country's largest Muslim organization. There seem to be three time regimes: (actually, I've added two more...) * Regime 3 (timescale: days) -- Lawyerly: Tim, this is Fred Jones. I just talked to the DA and he wants you to either arrange a time to turn yourself in at the station or he'll send a squad car out. I can be there if you want. Or the search warrant version: Tim, I've looked over the search warrant they'll be serving on you and everything looks to be in order. Don't say anything, and don't interfere. Just sit down and they should be out in a couple of hours. * Regime 2 (timescale: several minutes) -- Local cops at the door. A knock on the door. A cop or sheriff's deputy, often known to the target in various ways, arrives with an arrest warrant, search warrant, etc. The target has a reasonable chance to verify that the cops or deputies are legit. * Regime 1 (timescale: tens of seconds to minutes) -- Bangs on the door. This is the police! Open up! If the target opens the door and the supposed cops are actually home invaders, or rival gang members, he's dead. Or the supposed cops may be Feds or narcs without proper justification. No time to carefully verify credentials. * Regime 0 (timescale: seconds, or less) -- Flashbangs and Ninja Raiders. They burst through the windows, throw flashbang grenades, scream, stomp dogs and cats, and shoot anything that moves. Black baggers generally have to get in and out quickly with incomplete knowledge of your situation. Doing a thorough reverse-engineer of you location is usually not an option for them. Physical security. Litter the area with cameras, possibly in several mutually independent networks. It is impossible to get physical access to the computer without being seen. Don't forget battery backups. A hardware keyboard logger is sometimes a friend, especially if built right onto the motherboard. The computer's case can be welded-shut, preventing easy access to the disks and slowing down the adversaries. Another measure could be a computer sniffing and logging all communication to/from the computer over the LAN, into a circular buffer, allowing forensic analysis of any communication that was potentially improper. This serves as security camera guarding the network access. Similarly, the kernel on the protected machine itself can log accesses to certain parts of filesystems or physical block devices, and prevent loading of modules that aren't cryptographically signed. ...of course, a shotgun as an active defensive device has its certain appeal. However, there are usually more blackbaggers than one, and computer aiming could be unreliable against fast-moving panicking targets, so a nerve gas should be considered an option. (If you aren't in a killing mood, a tear gas could do its job too. A device that would pierce a spray can with a self-defense paralyzer, quickly dispersing it in the room, could theoretically work nicely too.) A good area denial device could MAYBE be a device made from teflon and magnesium strips; teflon pyrolysis products are reportedly pretty toxic; but I am just wildly speculating here and inviting discussion about the weak sides of my ideas. The shotgun could also serve as a quick data destruction device; imagine what a swarm of fast-flying steel balls can do with disk plates spinning on 10,000 rpm. If the impact primer will be replaced with electrically controlled one, even better - the system then has no moving parts and gets inherently more reliable and maintenance-free. The barrel could be improvised from a piece of a steel pipe, with a suitable length to allow the payload from the shells to reach suitable velocity to shred the plates, attached on the disk over its top side which is usually fairly thin aluminum. It's getting a lot easier to start an online business these days. I've been doing market research and industry analysis in the IT industry for 20 years and I thought it might be time to branch into something different: biotechnology. My new company is called OmegaBio (www.omegabio.com ). I have been able to get it operational and do some clever things that would have been ridiculously expensive a decade or more ago. First of all I needed to research my market. I used Google and a few other search engines, and used all sorts of combinations of biotechnology, market research, industry analysis, database and so on until I had a pretty good list of the dozen or so companies operating in the field around the world. I was able to visit their websites and compare my planned products. I got some good ideas and spotted some gaps. Before the web, that sort of research would have taken months. Next I had to build my infrastructure. I had a few old PCs and laptops and I bought a couple more for under $1000 each. Networking PCs is now child's play - you just buy a cheap router and plug them all in. I live outside town and I'm too far from the exchange for ADSL, but Telstra and a few others provide two-way satellite. I used an old PC for a proxy server and all my networked machines now have a permanent high-speed internet connection. The next step was staffing. I put a job ad on the website of my local university and I got dozens of responses within a few days. Then I had to build my products. The great thing about the information industry is that you don't actually have to make anything - you just harvest available information, repackage it and add value to it. I got my students to work on the net getting all the information I needed to build my first few products. I needed to build a database of every organisation involved in Australia's biotech industry. Again, dead simple. Everybody I want to know about has a website and there's sufficient information there to build up a decent database. The net is a notably anarchic place but you can write little software routines (one of my students is a whiz at this sort of thing) that go to websites and pull out things like name and address information. We then dumped it all in Excel, wrote some little macros to convert it all into the same format, duplicated it, then went back to all the websites and updated and confirmed the data. It's a fair bit of work but not difficult. I needed some publishing software, and some web design software, and some security software. Easy: do a search, find something suitable, pay a little on a credit card, and you have the software. I find I'm downloading things as large as 50MB nowadays. So now I have a fully functional market research company. I set it up for a song, hardly leaving the security of my mountain-top lair, and for an amount that would have been laughable a few years ago. I have a server, a network, high-speed internet access, sophisticated software and talented staff. I have a lot more work to do to make my new business a success, but the tools of the Information Age have made it vastly easier and cheaper than it once was. Mr Crean told the parliament that Mr Howard and Mr Anderson had not told the Australian public the truth. The government has signed up to a coalition of the willing despite the Prime Minister and Acting Prime Minister's assurances to the parliament that this is not the case, he said. US President George W Bush today said he considered Australia to be part of his coalition of the willing in his efforts to disarm Iraq. But Mr Howard told journalists in Washington that comments by Mr Bush did not alter Australia's stand that it had made no commitment to join a war on Iraq. Mr Howard and Mr Bush met for 40 minutes at the White House and then continued to discuss the Iraqi crisis over dinner. Mr Crean said comments from Mr Bush today had given the game up for the prime minister. Three words today from the US president gave up the game up for John Howard, he said. Asked directly if he considered Australia part of the coalition of the willing Mr Bush said: Yes I do. What that means is up to John, Mr Bush said. Mr Crean told the parliament it was a different response to that given by government leaders to the Australian public. The problem with defending America's 'cause' February 11 2003 If Saddam is a criminal, then so too was Richard Nixon, Lyndon Johnson and Queen Victoria, writes Phil Cleary. Pamela Bone, in her column Losing patience with the left last Saturday, only confirms how tough it has become to defend America's war plans. Even Robert Manne, who could hardly be accused of being from the left, accepts, in his column yesterday, that the democratic-humanitarian argument for war in Iraq is flawed. Contrary to Bone's assertions, the left's opposition to the proposed US war on Iraq has nothing to do with cultural relativism. In recent times Bone has unearthed some barbaric acts of terror against women in fundamentalist Muslim countries and has quite reasonably asked whether cultural relativism had been behind the West's refusal to act against these governments. And although Saddam Hussein doesn't qualify as fanatically Muslim, she can still find an outrage - the alleged public beheading of two prostitutes in Iraq - to tug at our heart. Such acts should be condemned. But if true, should they help persuade the left to support the invasion of Iraq? If the answer is yes, how do we defend our own legal and political system's acquiescence in the family violence now being unearthed in Australia? A society doesn't have to behead prostitutes or engage in genital mutilation to be a partner in terror against women. Ask the battered women who flee to dehumanising refuges or experience humiliation in our criminal justice system whether they know terror. Sadly, I hear so many stories that I'm past the it only happens in Muslim countries mantra. If our record on family violence hasn't been bad enough, how do we explain the murder and dispossession of indigenous Australians and the stealing of their children - something close to Manne's heart - by the state? I'm no cultural relativist. I'm just conscious of how easy it is to be well meaning yet unwittingly practising a mixture of cultural imperialism and hypocrisy. And we shouldn't forget that the most vociferous proponents of military intervention to free Iraqis from Saddam's terror are often the same people who demand that refugees from Iraq should be treated like criminals and sent to barbed-wire zoos in the Australian desert. On the road to democracy, Britain and America were guilty of some of the worst crimes against humanity. British government complicity in the Irish famine, the grinding poverty and social dislocation of industrialism and convict transportation, and barbaric public execution don't belong in Britain's dark ages. The slaughter of the American Indian, the enslavement and murder of black Americans, the blood-soaked Civil War that brought about the union, and the napalming of Vietnamese villages are part of America's recent history. Yet the kings and queens and presidents who presided over these epochs are treated as heroes in the history books. If, as Bone argues, Saddam should be put before the International Criminal Court, should presidents Richard Nixon and Lyndon Johnson, and Queen Victoria's ancestors, be dealt with posthumously to show we are not hypocrites? Do the defenders of war think Nelson Mandela was missing the point when he told the world that George Bush couldn't think straight and this war was about oil? Was Mandela being a cultural relativist when he asked why no one condemned Israel for having nuclear weapons? Bone provides us with an answer when she says criminal states cannot be allowed to have weapons of mass destruction. It's right for Israel, the US and Britain to stockpile nuclear weapons, but we can't let those Arabs follow suit. Is it any wonder Malaysian Prime Minister Mahathir Mohamad likens us to a Western sheriff and Muslims generally believe we are racist? Racists could never be accused of cultural relativity. A war against Iraq won't liberate the people of Iraq or stem the potential for terror. And imposing a puppet government won't lead to an improvement of human rights or end the jarring infant mortality that cripples Iraq. Instead, it will reinforce the view in the Arabic world that Western governments are blind to the fabric of their life, but cunning and mercenary where their own economic interests are concerned. The responsibility for regime change in Iraq - as it was when Americans embarked on their War of Independence against England, and when Oliver Cromwell began the struggle that culminated centuries later in English Chartism and the vote - belongs with the sovereign people, not some imperial power. The political arguments aside, I wouldn't follow George Bush into the park to play ball let alone into the Gulf to play war. I'd rather sit and listen to Nelson Mandela. Remember what I said about how, in such a market, the people who made the *new* stuff first would make the most money, about the first copy being the most valuable? Read this, and then go look at the charts on the web. It's important. Now, think about a bearer-settled cash auction of the first copies of new content into a napster-like network. Remember that each cryptographically-authenticated (I dislike the word signed, I agree with Perry Metzger and Carl Ellison; signature doesn't mean what it says) copy is fungible. It's the same as any other. Thus, the market, like all commodity markets, is operating, in an economic terms of art, under perfect competition. I'd always thought that the price curve in hops from the original source and, in time from a given product's introduction to the net, would look like power curves, or maybe a gamma distribution, but, in Clay's article below, here's proof, or at least as much proof as we're going to get until we actually do it. I expect that the propagation rates of these markets are going to be *very* fast, which follows from the speed with which information flows through the net. Seen in three dimensions, with the charts laid on top of each other we get something that looks like what happens after a water drop hits a smooth pond. This idea of recursive auction markets across a geodesic network is, for the most part, a fundamental indictment of the very economic efficacy of copyright on a geodesic network. In getting what people want for what they're most willing to pay for it, for the lowest cost of production and distribution, this kind of market will make more money, faster, for the *producers* of content, and will adequately compensate the *distributors* of content (people who continually resell their copies to the highest bidders, of course :-)), while, at the same time, not requiring monitoring the entire system by a single entity. Like Gilmore said about censorship, if there's cash and an auction mechanism, the network will finally see copyright as damage and route around it. If you gave a program spec to a programmer and said write this you wouldn't be able to claim you wrote the code yourself, no matter how good or essential the program spec was. As to mounting the disk without software, not a problem it could be done all in hardware. Though you'd still need the passphrase/dongle. you couldn't *mount* a disk in hardware; you *could* decrypt on-the-fly and make the physical disk look like a unencrypted one, but you would still need non-crypto software to mount it. for virtual drives, the real question is at what point in the boot process you can mount a drive - if it is not until the os is fully functional, then you are unable to protect the os itself. if the bootstrap process can mount the drive before the os is functional, then you *can* protect the os. No you can't. If the drive is mounted before the OS is loaded you can put the system into a DMA state and read the disk (screw the OS) since it's contents are now in plaintext. no, you can't. data from the hardware is *still* encrypted; only the output of the driver is decrypted, and a machine no longer running bootstrap or os is also incapable of decryption. you *could*, if good enough, place the processor in a halt state and use DMA to modify the code to reveal the plaintext, but it would be a major pain to do so and would require both physical access to the machine *while powered up and without triggering any anti-tamper switches* after the password has been supplied. This is actually a weakness in firmware cryptodrives (as I have seen advertised recently) - once the drive is unlocked it can usually be swapped over to another machine and the plaintext read. You can also prevent the default OS from being loaded as well. Indeed so, yes. however, usually that decision has to be made before the password would be entered - so making more awkward. you *could* finangle the bootstrap though; there must *always* be part of the code outside the crypto envelope (but of course this can be removable media such as the usb drive mentioned, and stored securely when not in use) Clue: If you own the hardware, you own the software. indeed so. however, if that applied to machines not already running, the police wouldn't be so upset when they find encrypted files on seized hardware.

The ongoing conspiracy (an agreement to commit a felony) continues after various events. For example, if Ted and Alice have an ongoing implicit understanding that they will meet in the shed behind her house occasionally to tend the five marijuana plants growing there, that is an ongoing conspiracy to commit a federal felony. So if, a week after Ted's last visit, Alice sends him an encrypted email saying Come over and watch a video, or whatever, the prosecutor can clearly use that (if he can decrypt it) as 5 more years in prison, since it used encryption technology and concealed an incriminating communication (the crime being conspiracy) that they are commiting (ongoing). The prosecutors can get Ted's passphrase by granting him immunity (probably ONLY immunity from the encryption enhancement penalty, or best case, from that and conspiracy, still nailing him for the pot felony, or getting Alice to roll over on him for the whole deal) and forcing him to disclose it having eliminated his 5th amendment defenses. Then they have Alice for the pot felony, conspiracy, and the 5 year encryption booster. Of course, they will simply hang all of this draconian punishment over her head, her attorney will say they can fight for $75,000 and 2 years, during which she is in jail, or they can plead it out and become a felon with few further rights of citizenship. And if you detail a crime after the event in an encrypted communication, you've essentially included another person in the knowledge of a past crime in the expectation that such disclosure will remain secret from law enforcement. That is conspiracy to avoid prosecution and probably obstruction of justice. Conspiracy and obstruction are crimes, you've just used encryption in a federal felony, 5 year enhancement. Bye.
