Bug#602250: typo3-src-4.3: jsmin.php is non-DFSG

It was written by Geoff Stearns, author of SWFObject, so if Quicktime is still
relevant, he'd probably be willing to re-release this script under the same
license as SWFObject (which is MIT).

I wrote an email to him and this was his answer :

Yes, I should have added the MIT license to it, though keep in mind it's
really really old code and may not even work that well these days...

Hi Geoff,

i'm the debian maintainer of typo3 and now faced with a license problem
with your qtobject code. typo3 includes this module but your license is
not free enough for debian.
i got the following bugreport:

On closer inspection, typo3/contrib/flashmedia/qtobject is non-free by
omission (no explicit permission to distribute modified versions), but
probably intended to be free software:

There are no usage restrictions on this file, feel free to
distribute this code and associated files.

I want to ask you if you could rerelease this code under a license,
that is on this list of dsfg compatible licenses:
http://wiki.debian.org/DFSGLicenses#TheBigDFSG-compatibleLicenses

Thank you in advance.

Sure this doesn't suffice to be a license change, does it?
I asked him to change the license more offically on his website and
now i'm waiting for some reply.

No. non-free by omission doesnt exist, no usage restrictions is what
counts and obviously includes the right to modify+distribute it, else it
would be a usage restriction, d'oh. Compare also with the WTF licence, which
only says do what the fuck you want with this software, which is a
perfectly fine+free software licence.

jsmin.php OTOH, if the licence still says as you said in this bugreport, is
clearly non-free.

cheers,
Holger

Plain wrong. modify/distribution is no usage, its modify / distribution.
And thw WTFPL says much more than what you quoted, and that more is making
it free. The text above is not.
