No. non-free by omission doesnt exist, no usage restrictions is what counts and obviously includes the right to modify+distribute it, else it would be a usage restriction, d'oh. Compare also with the WTF licence, which only says do what the fuck you want with this software, which is a perfectly fine+free software licence. Plain wrong. modify/distribution is no usage, its modify / distribution. And thw WTFPL says much more than what you quoted, and that more is making it free.
