The original question's answer is still YES. Recording software IS
legal. It was and is a stupid question.

Is what you do with it legal ? is the sensible question which you have
answered most eloquently.

as you don't get caught." Using a little common sense, copying or
recording only for your own use and not trying to go into business
selling bootlegs, leaves it pretty unlikely anyone will notice or bother
you. Making a big deal out of it and openly waving it around or making
money from it increases the likelihood that A) someone will notice, and
B) someone will decide to "make an example of you", for their own
political, professional, or financial gain. Surely I'm not the only one
who remembers how Napster started?

Actually, the "everyone on this forum" implies reach way beyond the UK
reference.  It's why I said you need to be more careful making such

No the digital copy of a mp3 file is illegal too. Because it is digital
it is the same as the original. It is legal to make an analog copy of
the mp3 file.


I think this whole discussion is as meaningless as "what's the maximum 
speed you are allowed to drive?". It depends on your country. Laws are 
different. In Switzerland you're still allowed to exchange 1:1 CD copies 
among friends and family, or download from their server or their *box 
account etc. Yes, it's legal. But you're not allowed to use bit-torrent 
to do the same, as you can't control who you are sharing your files with.

illegal, provided that you will not publish the results.
More precisely, you are moving in a grey area.

In Canada, format shifting is EXPLICITLY allowed, provided that you own
the original.  So ripping a CD to listen to it through Squeezeboxen is
completely legal. This arrangement is increasingly common in other
countries.

What is not, in Canada, allowed is breaking copy protection.  Since copy
protection in music is now rare, it's mostly irrelevant in that context.
In the case of video, where copy protection is ubiquitous, it's a
different matter.  But in Canada liability for non-commercial
infringement is limited to fairly modest amounts, the aggregate for ALL
infringements is limited to between $100 to $5000 (as distinct from
per-infringement).  It's also limited to actual losses by the copyright
holder, so any pursuit of infringers is unlikely.  Commercial
infringement is a very different matter.

The impact of the recent copyright legislation in Canada (2012) is on

locks on DVDs) are not legally permitted for individuals, it's unlikely
that non-commercial activities (e.g. copying a DVD borrowed from a
library for personal use) will ever be penalized.

In Denmark it is illegal to make a digital copy because the quality is
identical. If you use a taperecorder, you will not have a exact copy.

It is legal to make a copy of your own CD's and place them on a HD, as
long as you are in possession of the original CD.

Under fair use it means you are recording the sample (and it should
normally be just a sample not an entire track) for parody, criticism, or
other legitimate commentary.

Fair use provides no protection for arbitrarily recording protected
works for indefinite later replays, even if you have no intention of
sharing or distribution of that content.

It *may* provide protection for format shifting, I.e. ripping LPs/CDs
you own for playback by yourself on other devices in other formats, but
even that is mainly "tolerated" and not explicitly protected, it's just
the wording is unclear.

Fair use personal recordings are a statutory right in law for many
countries.
No contract a copyright holder claims you have entered removes or
lessens those statutory rights. In fact they are likely breaking the law
if they even imply your rights have been reduced.

So in countries where it is written in law you are allowed to make a
recording on the stream, that recording may be MP3, lossless or
whatever.

Never worry about what a companies policy or contract states, ask simply
what the law states. They may not be the same thing.

The software is legal what you do with it may not be. 
In U.K. it is legal to make a recording of something you own for
personal use. Digitising my vinyl to FLAC is legal but if I sell the
vinyl I should delete any copies made.
For the record I have kept every vinyl record.

You also have the terms and conditions for the services .

Radio migth be just as ok as it was with god old fm and tapedeck.

But a service like spotify clearly says no in their terms and conditions
you agreed to when signing up.

So software that records you computers output may very well be perfectly
legal and not really a problem.
Its what and where that matters .

Also of one designed an app specially for recording a certain service
and possibly even using thier API to select content. I would expect to
go down in flames , and spend my life in some never ending legal battle.

Legally no but they have not often bothered to prosecute "lossy"
recording methods like tape, historically. They were more concerned
about redistribution with the advent of perfect digital recordings.

I would record as flac because cross conversion between different lossy
codecs can introduce artifacts and sound bad.

I think it's rather simple: if it was legal, you wouldn't have to ask 
about it. You'd go download/buy the application to do it from a vast 
choice of offerings.

currently I try to get some clear informations about
recording-softwares, with which you are able to record, cut and convert
music from platforms like Spotify and Deezer into mp3-files.
While there is a big offer in the world wide web, I´m still not sure, if
they are legal or not. 

If somebody knows more about that issue, would be great to hear about.
Additionally with some suggestions if you have.
